Chairwoman Boyer reported that Teresa Eichner of the Mayor’s Office said at the previous meeting that this bill was being deferred while discussions took place with the Governor’s office about the possibility of him reappointing current board Vice Chair (and prospective Chairman) John Anderson to the board to a governor’s seat rather than a City seat.  The Governor’s office has not given any indication of its willingness to make that appointment.  Council Member Lee requested a letter from the Mayor’s office stating their communication with the Governor’s office and the response received, if any.

At the last committee meeting Council Member Schellenberg said that he had talked to Mr. Citrano about the possibility of Mr. Citrano declining reappointment in order to create a vacancy that John Anderson (see 2013-581 above) could then be appointed to.  Mia Jones of the Mayor’s Office reported that she had spoken to both Mr. Anderson and Mr. Citrano since the last meeting and they both understand that it is the Mayor’s call to make the appointments to this board and they are agreeable to whatever he decides.

Bill Summary

 

Council Member Schellenberg referenced a letter sent to him recently by John Winkler of Concerned Taxpayers of Duval County citing a City memo from the summer of 2011 stating that the appointment of Cindy Laquidara as General Counsel would be temporary until September 30th of that year to allow the mayoral transition to take effect.  Mr. Schellenberg believes that temporary appointment should have been followed up with an appointment process as outlined in the City Charter and a subsequent resolution by Council confirming the mayor’s appointee; that never happened, and he therefore questions whether Ms. Laquidara is validly appointed to the position she now holds.  The matter is now in court as a result of a lawsuit filed by Concerned Taxpayers challenging the validity the appointment.  Council Member Bishop stated that the Council in 2011 clearly understood the appointment to be temporary at the time, but now that 2 years have elapsed and the sitting General Counsel says that she holding the position legitimately then the only way to reach a conclusion is probably the Concerned Taxpayers lawsuit.  Council Member Boyer stated that the Task Force on Consolidated Government is learning that the Office of General Counsel is a linchpin to how the whole consolidated government is interpreted and enforced, so the status of the General Counsel is an extremely important point. Chairman Jones asked for a letter from the Mayor’s Office providing the Mayor’s explanation of how the 2011 appointment process does or does not comply with the Charter’s requirements.

Bill Summary

 

Council Member Boyer gave background about how this bill was developed by the Metropolitan Park Ad Hoc Committee during its meetings about noise complaints from activities at the park.  The bill provides 2 alternative methodologies: the promoter may meet a decibel level inside the park at the sound mixing board, or it may adhere to the current decibel levels at receiving properties if it uses new “sound steering” technology inside the park.
