Per OGC, adopts PDD conditions regarding the legal description, the written description, the revised site plan dated June 27, 2014, and the Development Services Memorandum.  Additionally, the retail sale of marijuana shall not be allowed and a day care center would only be allowed through exception.  A monument sign is allowed, not to exceed 8’ in height, with 32 square feet with external illumination only.

Per OGC, denies the appeal of E-14-26 requesting the retail sale and service of all alcoholic beverages for off premises consumption and thus upholding the decision of the Planning Commission denying the exception; set out Findings of Fact and Conclusions of Law.

Rules: Adds a provision that no one may be hired in the Inspector General’s office who is a current City employee or has been an employee of the City within the last 24 months; provides that the Inspector General shall provide semi-annual briefings to the City Council on the activities of the office; replaces appointment of the IG by the Ethics Commission with appointment by an IG Selection and Retention Committee composed of 7 members – City Council President or his/her designee, State Attorney or designee, Ethics Commission Chair or designee, TRUE Commission Chair or designee, Public Defender or designee, Chief Judge or designee, and the Mayor or designee – selecting a candidate from a list of qualified candidates provided by the Employee Services Department for confirmation by City Council to a contractual term of 4 years; the IG may be removed by a process initiated by the IG Selection and Retention Committee for neglect of duty, abuse of power or authority, discrimination or ethical misconduct, and the removal must be confirmed by Council; the committee has the power to appoint an Interim IG to fill a temporary vacancy; adds a requirement for review of City contracting activities to determine if a vendor contract fee is a feasible means of generating revenue to fund the IG’s office; adds reference to additional recognized professional auditing standards that will govern the IG’s work and requires the IG to develop and adhere to written policies in accordance with Florida accreditation standards for IGs; provides that the IG and Council Auditor shall mutually cooperate to the extent possible, subject to their respective professional standards on confidentiality, to avoid duplication of audit functions.

 

Finance: Rules amendment, plus adds a provision that responsibility for the biannual Government in the Sunshine compliance audit shall be transferred from the Council Auditor’s Office to the IG at such time as the IG’s office has an auditor on staff; adds a requirement that the Inspector General shall not have been found guilty or entered a plea of nolo contendere to any felony, or to any misdemeanor involving a breach of public trust.

Project Speed: adds a reference to Sec. 288.075, FL Statutes, concerning confidentiality; corrects REV grant amount from $6.5 to $6.6 million; attaches revised project summary to correct minimum amount of capital investment from $70 million to $50 million; attaches a Revised Exhibit 1 (revised project summary); attaches a Revised On File project agreement with the following provisions: a) clarifies in the agreement and in Exhibit B that the company is not constructing a facility; b) clarifies that the REV grant is based on a total project cost of $89 million; c) includes the Base Year value of $0; d) includes a sale clawback for the EDME grant; e) revises Exhibit A to state that the project parcel is confidential pursuant to Sec. 288.075, F.S., f) includes Exhibit D – Community Service Commitment.
