Substitute

Incorporates all changes made to date by the Council and committees. Moves the Disabled Services Division from Military Affairs, Disabled and Veterans Services to the Parks, Recreation and Community Services Department; moves the Senior Services Division from the Neighborhoods Department to the Parks, Recreation and Community Services Department; moves the Housing and Community Development Division from the Neighborhoods Department to the Planning and Development Department. The revised Planning and Development Department will consist of the following divisions: Building Inspection, Current Planning, Community Planning, Development Services, Housing and Community Development, and Transportation Planning. The revised Parks, Recreation and Community Services Department will consist of the following divisions: Recreation and Community Programming, Natural and Marine Resources, Disabled Services, Senior Services and Social Services. The revised Public Works Department will consist of the following divisions: Right-of-Way and Stormwater Maintenance, Mowing and Landscape Maintenance (previously approved by 2013-683-E) and Public Buildings reporting to a Public Works Operations Director; Engineering, Real Estate and Traffic Engineering reporting to the Public Works Director.

Per OGC, the Substitute changes the rezoning application request from a CCG-2 district request, to a PUD district request that generally permits truck parking and storage, as more specifically set forth in the site plan and written description. The property is currently zoned RMD-B. This is also a companion to small scale comprehensive plan amendment Ordinance 2014-125.

Incorporates all changes made by the Ad Hoc Committee on Metropolitan Park to date; deletes octave band regulation; provides for sound monitoring on an average basis over 5 minute increments with 10 minute intervals; provides for a system of graduated penalties for repeat violations.

Per OGC, the Amendment adds the following conditions to the PUD: 1) The subject property shall be developed in accordance with the Development Services Division Memorandum dated January 21, 2014, or as otherwise approved by the Planning and Development Department.

Amendment

Per OGC, the Amendment grants the appeal and approves the application for Minor Modification MM-13-24, subject to the following conditions: (a) Each dwelling unit shall have a two-car garage; (b) Each dwelling unit shall be at least 1500 square feet in area, and a minimum average of 1750 square feet in area in the aggregate; and (c) All required fencing shall be on the homeowner’s side of the subject property.

Amendment

Provides that any funds collected under subsection (b) as of Oct. 1, 2013 shall be returned to the Handicap Parking Fines Trust Fund within 30 days of effective date of ordinance.

Per OGC, the Amendment adds the following conditions to the PUD: 1) The subject property shall be developed in accordance with Section 656.399.46 (Area of situational compatibility overlay zone buffer requirements), Zoning Code; 2) Outside storage areas which require screening, shall be screened with a fence, berm or landscaping or a combination thereof, a minimum of six (6) feet in height and 95% opaque.

Changes first reading emergency to one cycle emergency; waives Code Sec. 260.201 to allow transport of more than 8 tires for the 2-week period preceding the buy-back event; waives Sec. 380.403 & 380.404 (uses of host fee fund) to allow use for the buy-back program; provides for reversion of any unused funds after the buy-back to the account of origin.
