Amendment

Per OGC, the Amendment incorporates a revised PUD written description, dated January 9, 2014, a revised site plan dated January 9, 2014, and corrects the acreage so that it reflects 5.86 acres instead of 5.97; and adds the following conditions to the PUD: 1) The subject property shall be developed in accordance with the Development Services Division Memorandum dated October 17, 2013, or as otherwise approved by the Planning and Development Department, 2) A northern buffer shall be developed and maintained in accordance with the northern buffer edge rendering attached hereto as Exhibit 4.

Per OGC, the Amendment incorporates a revised PUD written description, dated January 9, 2014; and adds the following conditions to the PUD: 1) The subject property shall be developed in accordance with the Development Services Division Memorandum dated September 24, 2013, or as otherwise approved by the Planning and Development Department; 2) A median or barrier shall be installed and maintained along Oak Bluff Lane to prevent westbound left turn access into the site; subject to the review and approval of the Planning and Development Department prior to the issuance of a Certificate of Use (COU); 3) At the time of Verification of Substantial Compliance, a minimum of one vehicular and pedestrian cross access easement with the property to the south shall be installed and maintained. The maximum width shall be twenty-four (24) feet. Such cross access easement shall be included in all plan submittals; 4) The developer shall pursue and provide documentation of request for a north bound dedicated left turn lane on San Jose Boulevard, south of Oak Bluff Lane which may require relocation of the off-site driveway, subject to FDOT approval at the time of Verification of Substantial Compliance.

Per OGC, the Amendment incorporates a revised PUD written description, dated January 3, 2014 and a revised site plan dated November 13, 2013; and adds the following conditions to the PUD: 1) Prior to final engineering approval, all remaining portions of the remaining property under PUD Ordinance 2005-543-E, currently owned by the applicant and identified as parcel 2 and parcel 3 on the legal description shall be recorded as a conservation easement in a form acceptable to the Office of General Counsel and the City shall initiate a Future Land Use Map Amendment to Conservation (CSV). No improvements, other than required utilities, storm water ponds, and the entrance road, shall be permitted.

Strikes the section which would have conveyed surplus City property to the Police and Fire Pension Fund as a credit against accumulated unfunded actuarial liability; adds language authorizing the PFPF to invest the fund’s assets in same array of investments authorized by F.S. 215.47 after giving 10 days written notice to Finance Committee prior to change in PFPF allocation plan.

 

Deletes authorization of the PFPF to invest assets in hedge funds.

PHS: Corrects scrivener’s errors; strikes the Jacksonville Landing and Greater Jacksonville Agricultural Fairgrounds from  the list of facilities at which special events must be permitted and adds language providing that special events on public properties that are leased to private parties are not subject to the Special Events permitting process;  strikes authorization for Public Works Director to enter into indemnity contracts on behalf of the City for special events liability; makes technical corrections as requested by the Council Auditor and Risk Manager; adds language allowing refund of cost deposits (to the extent that costs are not already incurred by the City) when events are cancelled by the promoter at least 21 days prior to the event.

Per OGC, the Amendment incorporates a revised PUD written description, dated December 13, 2013; and adds the following conditions to the PUD: 1) The subject property shall be developed in accordance with the Development Services Division Memorandum dated December 2, 2013 or as otherwise approved by the Planning and Development Department, 2) All trees greater than 5” in caliper along the western property boundary abutting Kingstree Drive West within the first 15 feet from the right-of-way shall be preserved, except where to accommodate access, utilities and provide clear site triangle subject to the review and approval by the Planning and Development Department, 3) There shall be no outdoor audio speakers installed on the subject property.

Rules: Attaches Second Revised Exhibit 3 (land conveyance agreement) which allows non-buildable parcels to be used for a community garden or pocket park; provides that if the one buildable lot can be subdivided, then the construction completion deadline is extended to 2 years from the date of the conveyance of the lot to Habijax of the Jacksonville Beaches.”

 

TEU : Deletes references to the two small, non-buildable lots and only conveys the one buildable parcel to Habijax of the Jacksonville Beaches; deletes the waiver of Ord. Code Section 122.423 regarding conveyance of surplus properties valued below $25,000; Attaches Revised Exhibit 1 (map) and Revised Exhibit 3 (donation contract).
