Amendment

Per OGC, rezoning on Baymeadows Road recommended for approval with condition:

1)     Applicant shall contract with a licensed waste hauler to empty its dumpsters a minimum of two times per week, which must be increased to three times per week if City receives complaints regarding offensive smells of dog waste.

Attaches Revised Exhibit 3 (revised written description dated October 1, 2015); attaches Exhibit 5 (Development Services Memorandum dated October 20, 2015).

Per OGC, rezoning on Philips Highway recommended for approval with conditions:

1)     Active recreation/amenities such as playgrounds, amenity/recreation center, pool, cabana/clubhouse, health/exercise facility and similar uses shall be provided at a ratio of a minimum of one acre of recreation land per 100 residential units;

2)     For up to a maximum of 40 lots, the maximum lot coverage shall be equal to or less than 60% coverage; for all remaining lots the maximum lot coverage shall be equal to or less than 50% coverage.

Amendment

Per OGC, sign waiver on San Juan Avenue recommended for approval with conditions:

1)     Sign face size must be reduced to 14 feet in length and proportionally in height (approximately 5 feet, 5 inches);

2)     Changing message board must be eliminated;

3)     Height shall be limited to the height of the existing sign, unless this causes the sign to be obstructed by the building;

4)     Unless otherwise precluded by underground utility location, as determined by an inspection performed by the City, the sign pole shall be moved inward from the location proposed as far as possible; however this inward movement shall not cause the reduced sign face of 14 feet by 5 feet, 5 inches to be obscured by the building.

Places revised agreement with CDI Corp. “on file” to 1) correct where payments are to be sent; 2) delete duplicative Sec. 12.2; 3) include a Revised Exhibit A-1 and re-label it as Exhibit 4; 4) remove Exhibit A-2 which is not referenced in the agreement.

Replaces development agreements for construction of covered practice field and amphitheater with additional amendments to the Jaguar lease incorporated into Amendment 14; adds provisions to Amendment 14 covering construction of South End Zone improvements; adds an invocation of the exception to Chapter 126.107(G) to allow the City to directly contract with vendors for the purchase of temporary seating for the stadium; adds specificity about waivers of Fire and Rescue Department, Planning and Development Department and Department of Public Works permitting and inspection fees; deletes provisions regarding authorization to erect marquee signs (to be handled via separate legislation); changes City oversight responsibility from Office of Sports and Entertainment to the Department of Public Works and Chief Administrative Officer. The substitute attaches revised lease agreements for the Multi-Use Covered Flex Field and the Amphitheater.
