Rules Committee: Council Member Gulliford reviewed the
actions of the committee from its meeting.
TEU Committee: Council Member Brown reviewed the actions of
the committee from its meeting.
RCDPHS Committee: Council Member Redman reviewed the actions
of the committee from its meeting.
LUZ Committee: Council Member Holt
reviewed the actions of the committee from its meeting, noting that the
committee recommended denial of 2015-316 (small scale land use amendment on Catoma Street); a vote in the negative supports the
recommendation of the committee.
Finance Committee: Council Member Clark reviewed the actions
of the committee from its meeting.
Council Member Crescimbeni reported that the subcommittee of
the Ad Hoc Neighborhood Blight Committee that he chaired last Friday
recommended a floor amendment to 2015-327 (prohibiting donation collection bins
in the city).
Council Member Jones said he will offer a floor amendment to
2015-377 (amending the property safety code regarding unregistered vehicles).
Council Member Crescimbeni expressed regret at having voted
at the last meeting for a first reading emergency ordinance to impose a
moratorium on the growing, processing or dispensing of medical marijuana
without having heard from both opponents and proponents of the measure and
requested reconsideration of the item. President Yarborough informed the
Council that Council Member Jones has an ordinance on the addendum to the
agenda to repeal the moratorium. Council Member Gulliford said that a
Jacksonville plant nursery is interested in applying to the state for the
Northeast Florida growing license. The owner of the nursery will be present at
the meeting to advocate for a reversal of the moratorium. Council Member Boyer
suggested the need for an amendment to the moratorium revocation to limit
growing of medical marijuana to AGR zoning districts. Assistant General Counsel
Susan Grandin cited a 1982 Second District Court of Appeals ruling that
legislative bodies cannot impose moratoria via emergency legislation. Council
Member Boyer requested an opinion from the OGC as to how that ruling affects
what the Council may or may not do with regard to this issue tonight. Council
Member Gulliford said that he has asked for a bill to be drafted for introduction
on the addendum to the agenda to lift the moratorium on growing and processing
marijuana, but not on dispensing it. Ms. Boyer indicated that she may ask for
that bill to be amended to include her AGR zoning requirement and then referred
to committee.
President Yarborough indicated that he would call for the
addendum to the agenda to be discussed just prior to the second reading items.
Council Members Crescimbeni and Schellenberg requested to be added as
co-sponsors on 2015-484 (the medical marijuana moratorium revocation).
Council Member Carter stated that he would offer a floor
amendment to 2015-337 (establishing a permanent process for permitting backyard
hens) to reduce the percentage of property owners required to sign an opt-in or
opt-out petition from 75% to 50% + 1.
