15-27

Amendment

LUZ: Per OGC, rezones to PUD for a Family Dollar store; replaces Site plan dated November 17, 2014 with new Site plan dated March 25, 2015; subject to the Development Services Division Memorandum dated January 20, 2015, and conditioned as follows:

o          Restrictions on site lighting.

o          Outside sales and display limited to within 10’ of building.

o          HVAC equipment to be mounted on the roof.

o          Dumpster to be screened on three sides with a masonry, 5’ wall and a gate.

o          6’ ht. masonry wall to be provided by applicant between the north side of the building and adjacent residential property to the north, no more than 12’ from building.  Transparent (non-opaque) fencing to connect wall to building with gate(s) that allow exit, but not entrance.

o          Property north of the wall to be maintained by owner of that property.

o          8-9 Leyland Cypress trees to be installed by applicant on north side of 6’ wall.

o          6’ ht. stockade fence to be installed by applicant along eastern property line of Lot 9 (the residential lot).

o          Ht. of store not to exceed 23’-4” in front and 18’-6” in rear (north side).

 

Floor: replaces Site plan dated March 25, 2015, as approved by LUZ, with new Site plan dated April 23, 2015; approves conditions as follows:

o          6’ ht. masonry wall to be connected to building with fence constructed of wrought iron or other metal, and secured access allowing only exit from area enclosed by the wall and fencing.

o          6’ ht. masonry wall to be extended from its easternmost point turning north to end at the southeastern corner of Lot 9, where it will connect with the 6’ stockade fence.

o          Leyland Cypress trees shall be 6’ ht. upon installation.

Amendment

Rules: corrects stadium name from Alltel Stadium to EverBank Field; changes incorrect Code section reference.

 

LUZ: per OGC, the amendment removes the Jacksonville Veterans Memorial Arena from the Sports and Entertainment Complex Sign Overlay Zone designation in Section 656.1337 for on-site signs so that exterior signage that would be otherwise considered off-site signs pursuant to Section 656.1302(1) would be prohibited at the Arena; corrects stadium name from Alltel to EverBank Field in the code chapter.

 

Finance: creates limitations on size and location of exterior signage on the Veteran’s Memorial Arena; corrects stadium name from Alltel to EverBank Field in the code chapter; removes proposed insertion of reference to “long term (in excess of 5 years)” naming rights agreement and removes proposed insertion of “for the entire facility”; strikes all of Section 2 of the ordinance – proposed amendment to City Charter Article 23 – Offsite Commercial Billboard Ban; strikes all of Sections 3 and 4 of the ordinance – proposed amendments to Code Sections 614.142 and 614.1309 – Unlawful sign messages.

o          Wall signs not to exceed 1/5 sq. ft. per linear foot of store front abutting Moncrief Rd.

Substitute

Clarifies:

  • that the council is concerned with secondary effects of free speech or expressive conduct that would entice, attract or lure children to vulnerable areas such as noted by the court in Hobbs v. County of Westchester;  
  • prohibitions to include participation in any “practice or event” that involves non-familial children and the distribution of candy or other items;
  • prohibitions to include the wearing of costumes, or anything that would alter an offender or predator’s appearance if that appearance “could or would entice, attract or lure a child to congregate around, or move closer to, that person.”;
  • the definition of “residence” to include a vehicle or vessel;
  • the prohibition on holiday decorations by replacing “decorations” with “any display”, and links the prohibition to the display “if such display could or would entice, attract, or lure a child onto, or nearer to, any residence” of an offender or predator
  • an exemption to the Section by stating that an offender or predator may attend an event if it is held in a location, “such as a personal residence which would not be enticing to” non-familial children.

Increases appropriation amount to Supervisor of Elections for election advertising by $15,003.37 to $485,112.31; attaches Revised Exhibit 1 (revised B.T.).

 

Floor: adds language clarifying that this appropriation includes the cost of advertising for 2 referenda on the May 19, 2015 general election.
