(Rezoning on Monument Road from PUD to CCG-1) Per OGC, approves rezoning to permit a convenience store and gas station, subject to attached documents; attaches Exhibit 1 (legal description); attaches Exhibit 2 (subject property per Planning and Development Department); attaches Exhibit 3 (written description); attaches Exhibit 4 (site plan).

(Amending Ordinance Code Chapter 191 – Special Events): appropriates $70,000 from Special Council Contingency account to provide funding for internal City costs for “neighborhood community events”, amends Ordinance Code Chapter 111 – Special Revenue and Trust Funds – to create a new Sec. 111.105(d) – Neighborhood Community Events Trust Fund; revises the definition of “neighborhood community event” to remove reference to expected number of attendees, to provide that such events may include planned entertain-ment, cultural or recreational event activities donated and paid for by third parties; excludes council member town meetings from the definition of “neighborhood community event”; revises portions of Chapter 191 regarding procedures for council members to schedule and request assistance from the Special Events Division for neighborhood community events.

Substitute

(Adoption of revised Tourist Development Plan)

 

NCIS: changes all references from “trust fund” to “special revenue fund”; combines two marketing categories into one; addresses Council Member terms pursuant to state law requirement for 4-year terms; amends budget for FY16-17 to meet contractual requirement to allocate 70% of bed tax revenue to Visit Jacksonville; directs the TDC to recommend to the Council within 6 months grant guidelines and procedures for awarding event and convention grants; adds language regarding authority of the TDC to award contracts and approve recommendations of the PSEC, CSPEC and GGAC in compliance with City Procurement Code; adds a requirement that at least 1 of the 3 representatives of the tourist industry have experience or background in commercial aviation and provides that the Jacksonville Aviation Authority qualifies for that purpose; requires that at least 2 of the 9 TDC members shall be residents of or work at the Beaches or Baldwin and clarifies that representatives from the Beaches and Baldwin could be elected officials, if permitted by law.

 

Rules: NCIS substitute, plus attaches a BT for a $500,000 transfer; provides that FY15-16 year-end fund balance in the tourist development revenue fund shall be split 50/50 between the facilities development account and the contingency account; revises Council Member appointments to include a requirement that if a Past President is not available to serve on the TDC then a council member with a demonstrated interest in tourism may be appointed.

 

Finance: Rules substitute, plus transfers $1 million from the Tourist Development Council Operations account to the TDC Development Account ($500,000) and the TDC Contingency Account ($500,000); transfers $2,500,000 of Tourist Development Council fund balance to the TDC Development Account ($1,250,000) and the TDC Contingency Account ($1,250,000); clarifies that the two tourist industry representatives from the Beaches shall be residents of or have their “principal or qualifying place of business” at the Beaches; adds a provision that none of the changes in qualifications or terms of Council Member appointees shall apply to members currently serving on the TDC.

Amendment

(Appeal of Planning Commission final order approving zoning exception and administrative deviation with conditions for sale and service of alcoholic beverages on St. Johns Avenue, and the reduction of parking spaces from 10 to 0) Per OGC, inserts a new Findings section regarding Planning Commission compliance with the essential requirements of law and competent substantial evidence; grants the appeal and makes the approval conditioned on the following: 1) the development shall serve no more than 100 occupied seats, inside or outside, at any time; 2) the development is subject to the conceptual site plan dated 11.15.16 or as otherwise approved by the Planning Department; 3) the developer shall require employees to park off St. Johns Avenue and nearby residential streets using a developer-provided off-street parking lot; 4) the restaurant shall stop kitchen service no later than 12 midnight; 5) other conditions pertaining to trash and grease storage and disposal required by the Planning Department in its approval dated 8.18.16 shall remain in effect; 6) applicant agrees to withdraw E-16-72 seeking a second 100-seat restaurant; 7) exception shall be personal to the license holder; 8) the City’s Municipal Code Compliance Division shall be granted access to the building to inspect and insure compliance with conditions; 9) prior to requesting a final building inspection or occupying the facility in any manner, the lead horizontal and vertical design professionals shall submit separate certification letters to the Planning Department confirming that all horizontal and vertical components have been substantially completed and all conditions to the development order have been complied with; attaches Exhibit 2 (conceptual site plan showing layout of tables, chairs, bar and kitchen).

(Appropriating $160,404 from Special Law Enforcement Trust Fund 2016-2017 Operating Budget for SPETF - Violence Reduction Initiative - Year 2): attaches Revised Exhibit 1 (revised BT); attaches Revised Exhibit 2(revised certification).

(Appropriating $80,074 from U.S. Dept. of Homeland Security/FEMA to JSO, with no local match, for the State Homeland Security Grant Program): changes “September” to “October”.

(Appropriating $195,318 ($146,489 from U.S. Dept. of Homeland Security - Port Security Grant Program & Local Match of $48,829) to purchase emergency preparedness equipment): adds new Subsection C – Explanation of Appropriation.

(Appropriating $999, 961 U.S. Dept. of Justice “Safe and Thriving Communities” grant):

 

NCIS: strikes reference to B.T. 17-020; attaches Exhibit 4 (signed grant award letter); attaches Exhibit 5 (grant budget detail).

 

Finance: NCIS amendment, plus adds reference to City oversight by Office of Grants and Compliance and the Mayor’s Office through the Jacksonville Journey in the bill title.

(Approving Tax Collector lease agreement in Tradewind Plaza): reduces lease term by 2 months; changes start date to October 1, 2017; provides that during the 5-year renewal option the annual operating cost shall increase from $5 to $6 p.s.f.; attaches Revised Exhibit 1 (revised lease agreement).

(Appropriating U.S. Homeland Security grant and local match for purchase of an emergency response boat and various safety equipment): changes a reference to “all capital” purchase from a multi-gas meter to 6 lightweight chemical detectors; removes fiscal year carry-over language; attaches Revised Exhibit 1 (revised BT); attaches Revised Exhibit 2 (revised agreement).

Amendment

(Approving a Mobility Fee Contract between the City, SWQ, LLC & Southwest Quadrant Joint Venture Co.) 

 

TEU: Per OGC, attaches Revised Exhibit 1 (revised agreement) to remove references to fair share assessment (except as it applies to the annual inflation adjustment) and to increases the mobility fee credit amount by $108,000 to $3,836,335 to correct a historical calculation error.

 

LUZ: TEU amendment, plus attaches a 2nd Revised Exhibit 1 (2nd revised agreement) which includes a provision that the credits must be used within a 2.5 mile radius around the road improvement that generated the credits (including portions of Mobility Zones 1, 2 and 8) rather than throughout Mobility Zone 1; attaches a new Exhibit D (2.5 mile radius map) to the 2nd Revised Exhibit 1.
