16-367

Amendment

(Amending San Marco Zoning Overlay): Per OGC, strikes most of the prohibitions to PUDs except the standards set out in the San Marco Overlay, allowing relaxation of the standards if specifically provided in the Overlay and limiting the PUD restrictions to the San Marco Overlay rather than applying them to all other overlays; allows relief from Subpart M standards if specifically stated in the Subpart; increases the percent of assessed value of an existing multi-family structure that is undergoing renovation from 35% to 50% as the trigger point that would require the renovator to meet parking requirements; allows further reduction in parking if the repair and renovation is proposed as part of a PUD rezoning; allows increased height in the defined Transportation Corridor (portions of Atlantic Boulevard and Hendricks Avenue).

(Rezoning on San Jose Boulevard from PUD to PUD):

 

LUZ: Per OGC, attaches Revised Exhibit 3 (revised written description).

 

Floor (Boyer): LUZ amendment, plus approves rezoning subject to one condition - outside sales and service, and sales of alcohol shall be subordinate to and in conjunction with the assisted living facility.

(Requested sign waiver at Southside and Beach Boulevards): Per OGC, amends to approve the waiver subject to the condition that prior to any sign permit being issued, the applicant must provide proof of ownership of the property.

(Opposing changes to Florida’s water quality standards):

 

PHS: amended to express concern over changes to the standards and to urge the US EPA to provide appropriate public comment period and thorough evaluation of the proposed changes.

 

Rules: PHS amendment, except changes “67 chemicals” to “numerous chemicals”.

(Approving small scale land use amendment on St. Johns Avenue): Per OGC, corrects a previous ordinance number reference; increases the number of permitted dwelling units from 136 to 140.

Amendment

(Repealing and creating new Chapter 168 – Burglary and Robbery Alarm Systems): adds “or similar devices” to definition of “alarm system”; provides that if an alarm user renews their permit more than 30 days after it has expired, the renewal date shall be based on the original expiration date of the permit; changes the opening of the original 90-day alarm registration period from the date of the ordinance’s enactment to the date on which the JSO’s online alarm registration system is activated; provides that if an alarm contractor renews its registration certificate more than 30 days after it has expired, the renewal date shall be based on the original expiration date of the certificate; changes the opening of the original 90-day alarm contractor registration period from the date of the ordinance’s enactment to the date on which the JSO’s online alarm registration system is activated; adds a requirement for alarm contractors to comply with Sec. 553.7931, F.S.; changes “alarm installation companies” to “alarm contractors” on p. 12; rewords the section regarding the requirement for an alarm monitor to make at least 2 calls to different numbers to attempt to verify an alarm with the registered user; requires an alarm installation contractor to provide notification in writing to an alarm user (either by physical document or by provision of an online site) of the City’s alarm registration requirements; requires alarm monitoring companies to update customer contact information by accessing the JSO’s alarm registration database and requires that the companies attest annually that they have complied with this provision as a condition of their annual contractor registration renewal process; requires alarm monitoring companies (if they do not install the alarm) to notify each alarm user verbally (at a minimum, may also be in writing) of the City’s alarm registration requirements and requires that the companies attest annually that they have complied with this provision as a condition of their annual contractor registration renewal process; reduces the fine for a 5th false alarm offense in a year from $250 to $150, reduces the fine for a 6th offense from $500 to $250, and reduces the fine for response to a false panic or robbery-in-progress alarm from $500 to $250; provides for an educational program by the JSO to inform alarm users, contractors and monitoring companies of the requirements of the ordinance within 90 days of its effective date.

Amendment

(Appeal of Planning Commission final order approving minor modification with conditions on Philips Highway): Per OGC, names the appellant, Christopher Bray; deletes reference in a Whereas clause to the appellant having standing to appeal; inserts two new Whereas clauses stating that DFH OFFICE has agreed to dismiss its petition for writ of prohibition in its lawsuit and stating that MMA-16-14 is hereby amended as stated herein; inserts a new Section 2 – Findings to amend MMA-16-14 to include conditions: 1) two illuminated double-faced pylon signs operating as changing message devices are permitted, each of which shall not exceed 600 square feet in area on each side and 40 feet in height, which shall be mostly perpendicular to Philips Highway (range between 85 and 95 degrees), located as shown on Exhibit 1; 2) one illuminated double-faced monument sign for identification is permitted, not to exceed 120 square feet in area on each side and 20 feet in height; 3) hours of operation of the changing  message signs shall be limited to 7:00 a.m. to 8:00 p.m.; the signs may remain on 24 hours per day but outside these hours of operation the message shall stay static and shall not be permitted to change; 4) all signage shall comply with the definition of “on-site signage” as described in Code Sec. 656.1302(m); all signage shall comply with the definition of “changing message device” in Code Sec. 656.1302(c); except as specifically set forth herein, MMA-16-14 is not amended or altered and shall remain approved.
