BRIEF SUMMARIES OF AMENDMENTS and SUBSTITUTES

Amendment

Rezoning on Oak Street from CRO to PUD approved subject to conditions; increases acreage rezoned from 0.68 to 0.89 acres; attaches Revised Exhibit 1 (revised legal description); attaches Revised Exhibit 2 (location map); attaches Revised Exhibit 3 (revised written description); attaches Revised Exhibit 4 (revised site plan); attaches new Exhibit 5 (Development Services Division memorandum); attaches new Exhibit 6 (landscape plan) imposes conditions as follows:

·        No outdoor food or alcohol sales or service after 5 p.m.

·        Parking lot shall be developed with pervious material except for handicap spaces, loading or dumpster pad areas.

·        Hours of operation limited to Monday-Thursday 6:30 a.m. to 11:00 p.m.; Friday and Saturday 6:30 a.m. to 12 midnight; Sunday 6:30 a.m. to 11:00 p.m.

·        Requires 8 foot high, 95% opaque masonry, stucco or brick veneer wall on southern and western boundaries.

·        Required on-site loading space shall not be located behind the eastern-most building.

·        No ground or monument-style signage permitted.

·        On-site handicap parking spaces shall have a direct connection to existing Oak Street sidewalk.

·        No more than one curb cut access from Oak Street to the parking lot.

·        Lighting on-site and within the parking lot shall be consistent with pedestrian scale design guidelines in the Jacksonville Design Guidelines and Best Practices Handbook.

·        A knee wall between 2 and 3 feet high shall be constructed along the Oak Street frontage except where access is provided.

·        Minimum of 3 tree bump-outs required along the southern half of the parking aisle most adjacent to the southern property boundary.

·        All commercial deliveries, grease trap and dumpster pickups shall be between 8:00 a.m. and 8:00 p.m.

·        All live entertainment must cease at 10:00 p.m.

·        No televisions permitted.

·        Landscaping shall be developed in accordance with the Janet O. Whitmill Landscape Plan attached as Exhibit 6.

Rezoning at Philips Highway and Freedom Crossing Trail from PUD to PUD approved with conditions; attaches Revised Exhibit 3 (revised written description); attaches new Exhibit 5 (Development Services Memorandum); conditions include:

·        All signs must be at least 200 feet apart.

·        All sag lenses, drop lenses and convex lenses prohibited; illumination levels shall not exceed 0.5 foot candles adjacent to residential areas and 1.0 foot candles adjacent to non-residential areas; all lighting sources shall be metal halide, compact fluorescent or LED; maximum light pole height shall not exceed 30 feet; exterior lighting design must be submitted at time of Verification of Substantial Compliance and approved by Planning Department.

Floor (Gulliford): Attaches a Second Revised Exhibit 1 (second revised Property Appraiser’s budget) to increase the budget by $11,000 to cover the cost of an annual contract renewal accidentally omitted from the original budget submission.
