15-483

Amendment

Banking Fund de-authorization: changes requirements to fund projects with useful life of 5 years or greater and a value of at least $25,000; adds requirement that the administration report to Council pursuant to Council Rule 2.214 within 60 days of the closing of each borrowing issue to include amount borrowed, interest rate, and list of projects to be funded; clarifies that with the sunset of the Banking Fund, the projects so funded remain authorized, but no further borrowing will be done through the Banking Fund.

Substitute

Clarifies the enforcement processes available to Public Works for right-of-way encroachments; requires notice and an opportunity for the responsible party to correct the violation before formal enforcement  is initiated; creates the authority for the City’s enforcement officers to issue a stop work order; authorizes the City to abate the violation and place a lien on the property for the cost of the abatement; allows landscaping violations to be handled with a civil penalty; corrects scrivener’s error.

Amendment

Clarifies oversight for human trafficking signage; provides for an educational component; creates a special revenue fund to account for fines; funds shall be split 50/50 between Consumer Affairs (administrative) and JSO (enforcement); identifies violation as Class F offense with only one warning within a 12 month period and establishes $500 fine; requires signs to be in English and industry demographic language.

 

Floor: adds language to clarify the City’s ability to pursue remedies for violators who fail to pay citations.

Attaches revised agreement to include Attachments A (educational goals) and B (sponsor packages); includes new Attachment C concerning requirements to have Live SMART unit appear at COJ activities/meetings.

Rezoning on Century 21 Drive from PUD and RMD-D to PUD approved with corrected address; attaches Revised Exhibit 3 (revised written description); attaches Revised Exhibit 4 (revised site plan); attaches new Exhibit 5 (Development Services Division memorandum dated April 4, 2016.

Adds explanation of appropriation section to Human Rights Commission budgetary clean-up; clarifies that funds are also being used to fund existing employees and operating costs; deletes references to sub fund 1FB.

Sign setback waiver on Dix Ellis Trail approved subject to one condition – internal illumination is allowed but no changing message device shall be allowed.

Rezoning on San Marco Boulevard, Dante Place, Palm Avenue, Children’s Way, Flagler Avenue and Gary Street from various categories to PUD for MD Anderson/Baptist Cancer Center is approved subject to conditions:

Maximum height of all structures is limited to 115 except for Lot D parcel, limited to 50 feet; minimum off-street parking standard of 3 spaces per 1,000 square feet of gross floor area; vehicular and pedestrian access locations prescribed; signage limits; landscape buffer required; open space and pedestrian plaza requirement; architectural and massing design and building step-back requirements.

Account change; places revised agreement on file to remove City obligation for site prep work and  to require Cultural Council to inspect the work prior to each payment & only pay based on a percentage of completion basis.

Attaches revised BT and include appropriation explanation for Digital Risk economic incentive funding source; corrects reference to prior Resolution 2013-184-A; clarifies that Project Pinnacle was approved by Ord. 2016-706-E.
