Amendment

Per OGC, rezoning 0.89 acres at Glen Mawr Rd. at I-95 South from RLD-60 to PUD approved with revised site plan to show a preserve area if a billboard is constructed and the area that may be cleared in order to view the billboard; revises the written description; imposes conditions regarding

·        the permitting of any billboard,

·        the creation of a Preserve Area to be left in its natural state so long as a billboard remains, but allows for a billboard viewshed to be maintained as shown on the revised site plan, and

·        if the billboard is removed, the Preserve Area may be reduced to 40 feet from the residentially zoned property, but any structure immediately adjacent to the buffer may only be 40 ft. in height.  However, a structure may be increased in height, up to a maximum height of 60 feet in increments of 1 foot for every 2 linear feet the structure is placed away from the buffer.

Amends Council Rules to prohibit council members from responding to electronically delivered written communications related to any matter pending on the meeting agenda of a City Council or council committee meeting during the course of such meeting; council members must disclose the receipt of any such electronically delivered written communications and file the contents with the Legislative Services Division within 48 hours, except that recorded voice communications (voice mail) and any communications received via and automatically stored by a City device (i.e. City e-mail server) are exempt.

JEA Charter changes include the following: resets millage rate calculation to achieve a contribution floor of $114,187,538 with minimum annual increase of 1% over floor or the millage rate calculation, whichever is greater; provides for a 5-year agreement that continues if not modified at the end of the term; references BMAP credits as being covered in the Interagency Agreement and provides for reconsideration of value of the credits if federal or state law changes occur; makes corrections and clarifications in definitions  and borrowing language; provides for changes to the Neighbor to Neighbor program; provides for additional customer assistance programs option; includes requirement to address real property tax treatment for new/additional utility systems during consideration by Council; includes requirement to provide notice to Council of existing or proposed covenants that impair appropriations ability for new/additional utility systems.

 

Interagency Agreement changes include the following: acknowledges contribution and Charter in recitals; provides agreement among definitions; provides the JEA will not charge the City for BMAP credits through 2023; incorporates and replaces existing credit trading agreement; provides for a one-time $15 million contribution to be paid to the City by the JEA immediately upon execution of the agreement that the City will match over a period of 5 years to provide funding for water and sewer projects selected by a joint working committee and approved by City Council; incorporates a new septic tank phase-out support agreement; continues JEA’s project support services commitment of $1 million per year for specific TMDL reduction projects, and allows carry-over of up to $3 million to expire 2 years after the end of the Interagency Agreement; continues JEA’s capacity fee support commitment of $650,000 for specific TMDL reduction projects and allows carry-over of up to $2 million to expire 2 years after the end of the Interagency Agreement.

Amendment

Per OGC, rezoning 7.42 acres at 601 E. Adams Street, the amendment rezones the majority of the property to Central Business District (CCBD), and the remaining property, which is the subject of an easement granted to the City of Jacksonville for placement of a pedestrian walk along Hogan’s Creek, will be rezoned to Recreation and Open Space (ROS).  The easement is attached to the legislation as Exhibit 3.

Amendment

Per OGC, rezoning 2.03 acres on 3151 Beaver St. from PUD to PUD, the amendment attaches revised site plan (Revised Exhibit 4) to more fully define buffers, attaches revised written description as Revised Exhibit 3, adds the Development Services memorandum as Exhibit 5; and imposes 6 conditions regarding a landscape buffer, fencing, maximum pallet storage height, requirement to comply with the Landscape Code, prohibit truck idling prior to 8AM, and site lighting restrictions.

Amendment

LUZ: Per OGC, rezoning 3.80 acres on a portion of 1501 Riverplace Blvd. & adjacent property at NW quadrant of Prudential Dr. & Montana Ave. from PUD to PUD,  the amendment:

• attaches revised written description (Revised Exhibit 3) to more fully define the pedestrian plaza area,

• attaches revised site plan (Revised Exhibit 5) to more fully define the pedestrian plaza area and articulate other features such as vehicular drop off and pedestrian connections from Prudential Drive to the Riverwalk,

• attaches Exhibit 6 site plan to delineate the pedestrian plaza and the viewshed from the vehicular drop off to the Riverwalk,

• attaches the Development Services Memorandum as Exhibit 7, and

• imposes conditions regarding the signage, approval required by the Downtown Development Review Board (DDRB) and the Downtown Investment Authority (DIA) staff, details about the pedestrian plaza, building setbacks, and pedestrian connections between Prudential Drive and the Riverwalk.

 

Floor: LUZ amendment, plus inserts language that requires the required Active Recreation area to be located completely on Parcels A and B; strikes language that prohibits that the Pedestrian Plaza from being calculated as open space for another project; changes the date of the Development Services Memo from 1/16/16/ to 1/19/16; and corrects a misspelling.

Per OGC, small scale land use amendment that re-categorizes 9.99 acres on Garden St. at the intersection of Jones Rd. from Neighborhood Commercial (NC) to Low Density Residential (LDR) adds a specific text amendment to the Future Land Use Element to limit the development to 12 residential lots.

Finance 2: strikes Whereas clause regarding Council Auditor discovery of the SSVRP in 2012; attaches Second Revised Exhibit 1 (second revised settlement agreement) which sets John Keane's 2016 retirement benefit at $210,558.99, which is the midpoint between a first year retirement benefit calculated solely on the SSVRP plan ($234,030.40) and a benefit calculated solely on the General Employees Retirement Plan ($187,087.57).

 

Floor (Crescimbeni): adds a sunset provision making the ordinance null and void if the PFPF board and John Keane do not approve and execute the “Second Revised Settlement Agree-ment, February 16, 2015 – Finance” within 30 days of the effective date of the ordinance.
