Auditor Kirk Sherman distributed to the committee 2 replacement pages to be
attached to Special Report #786A – Update to Budget Summary for FY16-17,
representing the finalized Public Service Grant and Cultural Services Grant
allocations by the respective grant committees for the year.
General
Counsel Jason Gabriel gave the committee an update on the status of the
Loblolly Wetlands Mitigation Bank issue discussed at a previous meeting,
reporting that the Office of General Counsel conducted its own investigation of
the history of transactions by the bank and its contracted operator and largely
came to the same conclusions as reached by the Council Auditor. He has met with
the attorney for the operator (LMP) and both sides need time for more due
diligence research. He hopes to resolve the issue without litigation and will
update the committee at its first meeting in January.

Committee amendment which adds a provision requiring approval of an event by
the Council President. Deputy General Counsel Lawsikia Hodges explained the
different special events approval processes for events expected to attract
more or less than 500 attendees and explained the provision prohibiting
promotion of an event before it has been fully approved through the
multi-agency review process. A motion by Council Member Anderson to amend the
bill to provide that that Director of Finance and Administration “shall”
disburse funds after successful completion of the review process (eliminating
any potential for administrative “veto” of an event) died for lack of a
second. Council Member Schellenberg questioned the lack of a maximum amount
allocable to any one event and the lack of even distribution of funds among

Bill Summary LUZ: Defer Assistant General Counsel Susan Grandin explained the
rationale for the addition of a new exemption to the tree mitigation
requirements for a saltwater mitigation bank. Attorney Paul Harden,
representing the developer of the first saltwater mitigation bank in the
city, reported that at least 4 other major Florida counties have this same
exemption in their codes because it is necessary to encourage the development
of much-needed mitigation banks. He believes the exemption is justifiable
because creation of a mitigation bank is not “development” in the sense that
the tree protection regulations were intended to address. He explained the
history of the development of his client’s mitigation bank and the posting of
a letter of credit in lieu of paying into the Tree Protection and Related
Expenses Trust Fund until a final determination could be made of the
applicability of the tree mitigation ordinance to the saltwater mitigation

process for determining business square footage before or during fire
inspections and the change to the inspection billing process from the tenants
of commercial buildings to the building owner. The change results from the
settlement of a class action lawsuit filed against the City by a commercial
property owner for its previous inspection practices. Council Member Anderson
suggested the need to notify commercial property owners and inform them in
advance of changing the billing procedure so they know they will be

large increase in the surcharge on the Baseball Grounds but reported that
Jacksonville Jumbo Shrimp owner Ken Babby does not object to the increase.
Council Member Bowman suggested amending the annual fee increase to be either
3% or the annual change in the Consumer Price Index, whichever is less.
Finance Director Mike Weinstein recommended adopting the fixed 3% adjustment
and revisiting the subject after several years of experience. Council Member
Gulliford reported that he had met yesterday with the leadership of the
Jacksonville Symphony and had arrived at an acceptable resolution to their
concerns expressed at the NCIS Committee on Monday. The symphony has a long
list of maintenance and repair items for Jacoby Hall that it would like to
see addressed. In response to a question, Mr. Weinstein explained how the
City’s capital maintenance projects are evaluated and funded each year in the

Police and Fire Pension Fund employer contribution: Mike
Weinstein and Tim Johnson, Executive Director of the Police and Fire Pension
Fund, addressed the recent media reports of a potential $44 million increase in
the City’s employer contribution to the PFPF for FY17-18. Mr. Weinstein
explained the changes in the actuarial assumptions (primarily a reduced payroll
growth rate and a newer mortality table) that account for the potential
increase over the previous projections. He explained the state requirement that
the payroll growth rate be calculated on a 10 year rolling average except when
otherwise permitted for a compelling reason. Apparently the PFPF has been using
an alternative methodology since at least 2008 which has had the effect of
keeping the employer contribution lower than it would be pursuant to the
formula. There are three solutions to dealing with the potential employer
contribution increase for next year: 1) deal with a new employer contribution
rate in the collective bargaining process required to implement the sales tax
extension for paying pension obligations; 2) request permission from the state
to phase in the increased employer contribution over 3-4 years; or 3) waive the
local ordinance requiring annual actuarial studies of the City’s pension plans
(state law requires such studies every 3 years) and decline to adopt the new
study.
Tim Johnson noted that the actuarial report was released
prematurely, is only in draft form and still has many steps to go before being
finally adopted, perhaps in an amended form, if at all. A new actuarial study
will need to be done if and when the City successfully completes negotiations
with the police and fire unions to close the current pension plan and implement
a new retirement system. The PFPF Board will discuss the draft actuarial report
at an upcoming workshop and will make a recommendation to the City Council,
directing the actuary to revise the draft to reflect whatever assumption set
the board may choose to adopt. Mr. Johnson said that of the $44 million
increased employer cost projected by the new actuarial study, $33 million is
attributable to the payroll growth rate and $8 million is attributable to the
change in the mortality table. He explained the history of the changes in
actuarial assumptions adopted over the last 8 years and said it was the City’s
understanding that the state office overseeing local pension plans had granted
a waiver to use assumptions different from the state requirements. The General
Employees’ and Correctional Officer pensions have always used the state’s
standard assumptions. Council Member Gulliford felt that the 7.0% or 7.5%
assumed rate of return on City pension investments is too high and should be
reduced to a more reasonable return rate. Mr. Johnson explained the PFPF
workshop and final approval process and the subsequent City Council approval
process. If the Council substantially disagrees with the PFPF’s actuarial
report then the actuary for the General Employees’ Pension Plan can be
commissioned to do another study of the PFPF. If the results of those two
studies cannot be reconciled to the satisfaction of the Board and Council, then
a third actuary could be hired to arbitrate the dispute.
