Council President Boyer explained the major provisions of the substitute and the addition of clarifying language to a previous version regarding the City Council membership on the TDC to deal with a situation where there is no Past President currently serving on the council. Kirit Patidar, a hotelier and member of the TDC board, expressed his disagreement with the amounts proposed for allocation to the contingency fund and the reserve for facilities development. He believes that those allocations divert funds away from event attraction and ties the TDC’s hands when it comes to meeting the needs of potential events as they arise; the process to request an allocation from contingency through the City Council legislative process takes too long to be responsive. Council Member Bowman expressed disagreement with the revise tourist development plan as proposed and felt that the TDC board had not been given a fair opportunity to participate in and affect the policy proposal.

 

President Boyer said that the TDC would be delegated the task of developing guidelines and evaluation measures for event grants and would report back to the Council in 6 months. She proposed and amendment on page 4 of the bill regarding the qualifications of TDC board members to provide that at least 2 members must be resident of or have their “principal or qualifying place of business” within the Beaches or Baldwin; the amendment was approved. Monica Smith, the director of Convention Sales and Service for Visit Jacksonville requested changes in several of the allocation amounts for convention sales and marketing; after discussion the request was withdrawn. Ms. Boyer suggested an amendment to clarify that the proposed changes in the appointments of City Council members would not affect the terms of currently appointed members; the amendment was approved.

Council Member Newby explained the purpose of the bill. George Maxcy of the Newtown Success Zone explained the purpose and activities of the Zone. Council Member Gulliford expressed support for the work of the Success Zone but cautioned against establishing a precedent by allowing use of year-end fund balances by Council intervention before the City’s books are closed for the year and negative balances in other funds rectified with the available funds. He suggested that if the Council wished to establish a policy of reallocating  Children’s Commission and Jacksonville Journey year-end fund balances rather than allowing them to be swept into General Fund balance, then a formal allocation process should be established to evaluate and rate proposed uses rather than an ad hoc “first come, first served” process.

 

Finance Director Mike Weinstein cautioned that year-end fund balance in one fiscal year is used as a funding source for the next year’s budget and urged extreme discretion in using it for additional programming. He noted that the annual budget process is fundamentally a prioritization process and one-time proposals for projects using fund balances avoid that prioritization process. Budget Officer Angela Moyer suggested that the Council could revisit this proposed allocation when it deals with the overall allocation of fund balance after the fiscal year books are closed out in January. Colin Murphy of the Children’s Commission said the JCC was supportive of the Newtown Success Zone’s work. Council Member Brosche said that as the Council liaison to the Children’s Commission, she has had numerous discussions about the commission’s fund balance, why last year’s year-end balance was so big, and how it is being used. Mr. Murphy reported that the fund balance was generated largely from non-payment of contracts for non-performance according to contract terms.

In response to a question, Laura Stagner-Crites of the JHFA staff explained how this housing revenue bond request differs from the bond issue for the Eureka Gardens Apartments. Both use tax-preferred revenue bonds to lower the cost of providing subsidized affordable rental housing, but the Eureka Gardens issue was never reviewed by the JHFA. Former Mayor Brown exercised his authority under state law regarding to this type of bond issuance to approve the bonds in his capacity as the chief executive officer of the City without the JHFA/ City Council process. Council Member Gulliford said that he is considering introducing legislation to require that all such bond issues utilize the JHFA review/City Council approval process in the future.

Greg Pease, Chief of the Procurement Division, explained the need for the waiver authority to ensure that the City remains eligible for federal and state grants which may have procurement requirements that differ in some way from the City’s Procurement Code. The waivers would be granted on a case-by-case basis to the extent needed to maintain eligibility and would require the City to adhere to the applicable state or federal procurement programs. Council Member Katrina Brown urged the City to use the JSEB program to the greatest extent possible and said she wanted to be notified when any waivers under this provision are granted. Council Member Anderson suggested that the Finance Committee Chair be notified in addition to the Council Auditor as required in the proposal. Finance Director Mike Weinstein said that the state and federal agencies from which the City receives grants all have different versions of affirmative action procurement programs, some more vigorous in the area of minority participation requirements than what the City is permitted to do by various court rulings.
