Amend/Approve R: Amend/Approve The committee debated this bill at
considerable length. Director of Parks, Recreation and Community Services
Daryl Joseph explained the differential permitting requirements for events
with expected attendance of more or less than 500 people. Sports and Entertainment
Officer Dave Herrell explained the rationale for
the estimate of $5,000 per council district for the types of events expected
to be produced under the auspices of this ordinance. Deputy General Counsel
Peggy Sidman explained the Code provisions regarding expenditure of City
funds for food and beverages. The committee discussed the difficulty of
defining and prohibiting political events using this funding. The committee
also discussed private fundraising to supplement the limited council district
funds for these events, and Peggy Sidman outlined the potential Ethics Code
implications of council members soliciting funds. Council Member Gulliford
wanted assurance that the Beaches cities and Town of Baldwin would continue
to receive the use of stages and bleachers at no cost for events for which
those have traditionally been provided by the City of Jacksonville. Council
President Boyer asked Mr. Joseph and Assistant General Counsel Lawsikia
Hodges to very carefully define what is and is not a “special event”. DEFER |

Summary Fact Sheet Council President Boyer noted that
this bill represents the adoption of the first true, realistic, detailed
5-year CIP in many years. In response to a question about whether the
allocation of community redevelopment area funds by the governing boards of those
CRAs that have them need to be ratified by the City Council, Deputy General
Counsel Peggy Sidman said that the Office of General Counsel has nearly
completed a legal opinion on the subject that should be released by the end
of this week. Council President Boyer proposed two
amendments in addition to the Council Auditor’s amendments on the marked
agenda, the first adding a project for Fire Station #20 repairs and the
second adding a Palm Avenue Improvements project. The committee authorized
the General Counsel’s Office and Council Auditor’s Office to “true up” the
CIP and budget ordinances after Council takes final action on both bills to
reflect any changes in one that would affect the other. AMEND/APPROVE

the amendments approved in the NCIS Committee on Monday, which are intended
to place more responsibility for accurate record keeping and reporting and alarm
permit renewal notification on the alarm installation and monitoring
companies rather than on the homeowner or business owner. Assistant General
Counsel Lawsikia Hodges reported that the Florida Legislature passed a law in
the 2016 session pre-empting several facets of alarm regulation to the state
and said that several of the suggestions that have been discussed by the
committee are probably pre-empted by that law. Chief Larry Schmitt of the
Sheriff’s Office reported that the JSO receives approximately 45,000 alarm
calls each year, of which 98% are false alarms, costs the JSO 36,000 hours of
manpower. Approximately 183,000 alarms are registered with the Sheriff’s
Office, but none of the original registration data has been updated and much
of it (including contact phone numbers) is badly out of date. APPROVE

Summary NCIS:Defer In response to a question about why
this bill was filed as an ordinance rather than a resolution, Deputy General
Counsel Peggy Sidman explained that the state grant for which this bill is
being requested by the Greater Jacksonville Agricultural Fair Association
requires that the local government hold a public hearing prior to adoption of
the resolution of support. Since ordinances get automatic public hearings
under the Council Rules but resolutions do not, the bill was drafted as an
ordinance to ensure the holding of the public hearing. Council President
Boyer pointed out that the concept of moving the agricultural fair out of
downtown to a more suitable location has been discussed several times over
the years, and may be a consideration in whether the City wants to support
making improvements to the current facility that may increase its value and
raise the cost to the City of acquiring that property in the future. Council
Member Gulliford questioned how the Fair Association plans to raise the
remaining cost of the improvement project in excess of the state grant and
wanted assurances that the City would be responsible for any project

Council Member
Schellenberg reported that the Finance Audit Subcommittee had met recently with
Carr, Riggs and Ingram, the City’s independent
auditor, to hear a report on the City’s FY15-16 audit. The auditor’s gave the
City a good report and thanked the staff of the Council Auditor’s Office and
Finance Department for their outstanding cooperation.
Mr. Schellenberg also
reported on several issues discussed at a recent meeting of the Florida
Association of Counties that he attended. Sober houses – these are group
residential facilities for persons recovering from alcohol or drug addiction,
sometimes called halfway houses. The federal government has ruled that sober
houses are covered under the federal Fair Housing Act as serving people with
disabilities, so local governments may not discriminate against these
facilities in their location or regulation. The FAC believes that Congressional
action to change the Fair Housing Act is needed to allow appropriate
regulations to be imposed. Medical marijuana – the Florida Constitutional
amendment on the fall general election ballot may be the first step in opening
the door to legalizing recreational marijuana cultivation and use as occurred
in Colorado, which brings several regulatory issues into play. Colorado has a
county opt-out provision that allows counties to prohibit recreational use in
their jurisdiction. The distillation of THC (the active psychotropic substance
in cannabis) is a dangerous activity and may explosions and fires have resulted
from attempts to cook THC. Transportation of marijuana across state lines
between states that do and don’t permit legal marijuana use is problematic.
Finally, marijuana sale tends to be a cash transaction, so government offices
are finding that legal marijuana growers are paying their cannabis taxes with
large amounts of cash, which is more problematic than dealing with checks or
credit card transactions.
