Bill Summary Assistant General Counsel John Sawyer responded to several
questions from the committee about the contractual relationship among the
City, Friends of Hemming Park and Community First Credit Union regarding the
sponsorship agreement for construction of an improved stage in Hemming Park.
Roger Rassman, Vice President of Marketing for Community First said that the
credit union’s preference is to have its name on the stage for the full 5
year term of the agreement, even if Friends of Hemming Park is no longer
under contract to the City to manage activities in the park. Committee
members discussed the degree to which private contributions toward the cost
of the stage construction should reduce the City’s contribution to the
project rather than accrue to the benefit of FOHP. Vince Cavin, Executive
Director of FOHP, answered questions about the organization’s budget and
fundraising progress. A motion by Council Member Crescimbeni to specify the
amount of funding for different elements of the stage construction and to
prohibit purchase of accessory items such as sound and lighting systems was
withdrawn after the second to the motion was rescinded. AMEND/APPROVE 6-1

Florida (A Brotherhood Against Totalitarian Enactments/American Bikers Aiming
Toward Education) opposed passage of the bill without a clear and legally
defensible plan of action for the enforcement program. He stated that the
National Highway Transportation Safety Administration is circumventing a
prohibition in federal law against targeting enforcement activities at
motorcyclists by funneling grant funds to state and local governments to perform
targeted enforcement in its place. Sheriff’s Office Director of Patrol and
Enforcement Ray Walden described JSO’s historical enforcement efforts with
sobriety checkpoints and explained that, while motorcycle accident and
fatality data will be used to identify high need areas for enforcement, the
operation of the checkpoints will comply with the office’s standard
procedures. Chief Assistant General Counsel Stephen Durden said that the
Constitution and interpretive case law require enforcement actions to be non-arbitrary or capricious
and to check all sorts of motor vehicles, not just motorcycles, on an equal

Summary Fact Sheet Council Member Boyer said that she had been researching
the Florida Statutes and Ordinance Code provisions regulating the use of TDC
funds and she believes the TDC is not spending the funds entirely in concert
with state law; she therefore proposed to add a waiver to the ordinance
waiving compliance with the City’s Tourist Development Plan to the extent
necessary. She noted that the City’s Tourist Development Plan has not been
amended in many years and needs to be thoroughly revised. She also noted that
the TDC’s contract with Visit Jacksonville, Inc. to provide tourism and
convention marketing services expires next year and an RFP to advertise for
potential providers should be in development soon for release a year from
now. Council President Anderson noted that TDC revenues are running above
estimates for the year. Finance Director Mike Weinstein said that he would
ask the TDC to submit its proposed budget to the Mayor’s Budget Review
Committee for review and that it would be examined for compliance with the
