Chairman
Gulliford announced that he has requested the Office of General Counsel to
investigate whether there are legal grounds for the City to recoup funds paid
to former Finance Director Ronnie Belton who converted from the City’s defined
benefit to the defined contribution retirement plan just before his departure
from City employment and took a cash distribution from the defined contribution
plan that was considerably larger than what he would have been entitled to as a
non-vested member of the defined benefit
plan. Regardless of the outcome of that investigation, Mr. Gulliford plans to
introduce legislation to prevent that kind of plan conversion and cash-out in
the future.

Council Member Boyer, Mark Hendrickson, financial advisor to the Jacksonville
Housing Finance Authority, addressed the potential ramifications of defaults
on repayment of housing revenue bonds on the issuing agencies, noting that
the City has no financial liability for repayment of the bonds. Liability for
any financial loss lies with the bondholders. In reference to the case of
Global Ministries Inc., the owner of the troubled Eureka Gardens Apartments
project financed in part by housing revenue bonds issued in Memphis,
Tennessee where Global Ministries is headquartered, Mr. Hendrickson said that
state law differs between Tennessee and Florida and the fact that the State
of Tennessee penalized the Memphis Housing Finance Authority for issuing
bonds for troubled projects is attributable to the differences in state law.
He explained that the developer in the Eureka Gardens case utilized an option
in the City’s ordinance code to bypass the Housing Finance Authority and City
Council and got its transaction approved by former Mayor Alvin Brown as the
Chief Executive Officer of the City. Chairman Gulliford said that the Code
needs to be amended to remove the legislative body/chief executive officer
option and require all such transactions to come to the JHFA and City
Council. Council Member Boyer requested that future JHFA bills state whether
the borrower is a for-profit or not-for-profit corporation. APPROVE

Summary Finance Director Mike Weinstein gave
an overview of the bill, which authorizes the sales tax referendum as the
first of step of a multi-step process to provide a future funding source for
amortization of the unfunded accrued pension liability. If the referendum
passes, that would trigger a collective bargaining process with the employee
unions and ultimately further legislation by City Council to enact the
results of the bargaining process and institute the pension amortization
process. Council Members Crescimbeni and Bowman expressed concern about the
wording of the 75-word ballot summary and recommended that further efforts be
made to clarify the statement for the voters. Mr. Weinstein responded to
several questions about the progress of Better Jacksonville Plan capital
projects and their prospects for completion before the expiration of the BJP
sales tax in 2030. He also responded to several questions about possible
mechanisms for obtaining immediate relief for the City budget if the sales
tax referendum is approved by cautioning against speculation in advance on
hypothetical scenarios, which may tend to confuse the public and may
jeopardize the potential success of the referendum. He emphasized that a main
selling point for the resolution will be the closure of the existing defined
benefit plans if agreement can be reached with the various unions. Council
Members Gulliford and Boyer reminded the committee that previous City
Councils and pension study committees have wrestled with the pension funding
issue and could never arrive at a solution that would bind future City
Councils and guarantee that a funding stream would be absolutely dedicated to

At the conclusion of
the agenda, Council Member Brosche updated the committee on the work of the
Finance Subcommittee on Police and Fire Pension Fund Subpoenas, which she
chaired. The committee held several meetings and reviewed the documentation
provided by the PFPF in response to the subpoena, was satisfied with the
results, and did not see a need for any personal appearances before the Finance
Committee. Beth McCague, Interim Director of the Police and Fire Pension Fund,
reported that the board will likely hire a new executive director in the next
30-45 days. She and PFPF board member Bill Scheu have met with General Counsel
Jason Gabriel to discuss the process for hiring the PFPF’s attorney. The PFPF
board has held a workshop on investment fee rebates and has changed the board
policy on the process for authorizing lead plaintiff status on lawsuits from
the executive director back to the board.
Council Auditor Kirk
Sherman made a presentation on the Property Appraiser’s proposed budget,
explaining the timing of the review process locally in relation to the Florida
Department of Revenue’s earlier state approval process. The Property Appraiser,
Council Auditor and Mayor’s Budget Review Committee have reached agreement on
the proposed budget attached to the Finance agenda. The proposed budget
requests de-authorization of two positions and distribution of the salary from
those positions among other staff in the form of raises. Property Appraiser
Jerry Holland distributed information on the recoupment of improperly claimed
homestead exemptions prior to and after his election to the office and stated
that more sign-offs by additional taxing authorities are needed before his
office can award a contract to a third-party contractor who will investigate
and identify improperly claimed homestead exemptions for a fee.
Chairman Gulliford
asked Council Member Brosche to investigate the issue of companies on the
City’s vendor contact lists that do not hold current City business licenses.
