The committee voted to approve the three amendments on the Council Auditor’s marked agenda. Council President Anderson expressed the belief that additional work is needed to reconcile the differing opinions expressed by council members in previous meetings and recommended that the bill by deferred for one and only one more cycle while additional work is done. Council Member Reggie Brown asked Deputy General Counsel Lawsikia Hodges to review four additional amendments he had requested be drafted concerning the role of community housing development corporations (CHODOs) in the process.

 

The committee decided to hold a special meeting on Monday, April 25th at 9 a.m. to continue discussion of the bill and the proposed amendments.

Council Member Hazouri reported that he had met last week with Council Members Becton and Wilson on this bill and that he had asked for amendments to be prepared. He intends to propose another bill at a future date to deal with other aspects of human trafficking signage not covered by this bill. Council Member Becton distributed a “white paper” suggesting other amendments. Council Member Crescimbeni questioned the constitutionality of the state law requiring posting of signage by some types of businesses and not by others and wondered if the City incurred any legal liability by being the mechanism for application of the state law to the regulated businesses.

Assistant Council Auditor Kyle Billy requested the addition of a fourth item to the three listed points describing the substitute on the marked agenda to provide that the Friends of Hemming Park would pay for any cost overruns on the construction of the stage and to require that FOHP has a performance bond. Assistant General Counsel John Sawyer explained the stage sponsorship agreement and the need for a payback clause to Community First Credit Union should the City and FOHP end their park operation agreement short of its full term and leave Hemming Park unprogrammed. At the request of Council Member Bowman, Vince Cavin, the manager of Hemming Park, gave an overview of FOHP’s fundraising during the current fiscal year and talked about the organization’s future operating and capital budget needs. In a public comment period Seber Newsome III opposed the contracting of Hemming Park management to FOHP as being too expensive and urged the City to resume operation of the park itself.

 

Council Member Boyer offered and the committee approved a motion to incorporate language regarding a refund to Community First Credit Union of a portion of its contribution to the stage construction project under certain circumstances. The bill was then deferred to the Finance Committee’s special meeting on Monday, April 25th.

James Reichenbach, a lobbyist for ABATE (A Brotherhood Against Totalitarian Actions/American Bikers Aiming Toward Education), told the committee that federal law prohibits targeting enforcement at motorcycles specifically, which he equates to profiling, and urged that any enforcement should be applicable to all motor vehicles, not just motorcycles. He believes the National Highway Transportation Safety Administration is giving grants in order to utilize local governments to undertake actions targeted at motorcyclists that it can’t do itself under federal law. He stated that the grant application the City submitted says that the funds are specifically for motorcycle enforcement activities. Connie Benham of the Duval County Chapter of ABATE  believes this grant will pay for activities that will discourage motorcyclists from coming through Jacksonville and that the Sheriff’s Office will target its enforcement to areas known to be frequented by motorcyclists.

 

Council Members Boyer and Crescimbeni questioned Ray Walden, JSO’s Director of Patrol and Enforcement, about the Sheriff’s Office’s plans for enforcement. Director Walden said that the stepped-up enforcement would generally involve additional and more widely dispersed sobriety checkpoints and that stops would be made of all types of vehicles; motorcycles will not be singled out for extra scrutiny. Council Member Crescimbeni suggested that the Office of General Counsel be asked for an opinion on the constitutionality of the proposed enforcement efforts.

Assistant Council Auditor Kyle Billy reviewed the proposed amendments on the marked agenda. Council Member Bowman advocated for passage of perhaps the biggest economic development incentive package in Jacksonville’s history, which will provide a large number of jobs for people of all job qualifications and income levels in a part of the city where such jobs are very much needed. The JTA will partner with the City to provide transportation for workers to the site. Office of Economic Development Executive Director Kirk Wendland described the project and proposed economic incentive package. JTA Executive Director Nathaniel Ford described the construction of a new park-and-ride lot at Armsdale Park to serve the First Coast Flyer that will serve as a resource for a new bus route designed to serve the workforce commuting to Project Rex.

 

Council Member Boyer asked questions about the impact of greenbelt tax exemption for agricultural properties on the calculation of baseline property value for purpose of calculating the tax increment on which the incentive will be paid. She is curious about whether the JIA CRA uses the greenbelt tax value or the full assessed value for its calculations and Council Member Crescimbeni asked for information on which value was used as the baseline when the CRA was created. He will have the Special Committee on Economic Development Incentives consider the greenbelt issue at a future meeting. Ms. Boyer proposed and the committee approved an amendment providing that as long as the JIA CRA exists, its revenues will be the source of payment of the Project Rex REV grant.
