Bill Summary

 

Council Member Hazouri explained the intent of the bill and the new sign regulations, noting that the regulations would be enforced by inspections via the Sheriff’s Office and Fire Marshal’s Office, both of which visit the regulated businesses at least annually. Committee members posed questions about why only some of the various business types listed in the state law are being targeted for signage requirements while others are not and asked about potential costs to the City of creating the signage requirement and the business tracking database referenced in the ordinance. The bill was deferred pending additional information.

At the conclusion of the agenda the committee heard several presentations.

 

Joe Arnall, Managing Partner of Public Pension Consultants, LLC, made introductory comments and introduced Greg Woods, Vice President and Head of Investments for BPAS Fiduciary Services to discuss the recent reports received by the City from Arabesque Partners concerning the management cost structure of the City’s General Employees Pension Plan and Police and Fire Pension Fund. Mr. Woods explained that the Arabesque reports compiled data from the annual financial reports of 140 public pension plans from across the country and compared that data, grouped into categories by size of investment portfolio (less than $1 billion in assets, $1 billion to $5 billion in assets, and over $5 billion in assets), with Jacksonville’s pension fund management expenses. The average expense ratio for all funds was 38 basis points (0.38% of managed assets), with funds in the higher and lower categories generally paying a little less and the funds in the middle $1 - 5 billion range paying more. Jacksonville’s Police and Fire Pension Fund (falling in the middle size category) paid 0.59% in FY13. Over the last several years the PFPF’s actively managed funds (with higher fees) underperformed their benchmark index funds. Mr. Woods expressed the belief that BPAS could reduce the PFPF’s management costs by approximately 0.25% annually by using more index funds and fewer actively managed, higher fee funds, a savings of approximately $3 million per year. He believes the funds investments could have produced an additional $20 million in returns by just meeting the industry average performance. He expressed the belief that investment returns can’t be controlled, but management expenses can. Nationally the average of management costs seems to be trending upwards as funds try more alternative, actively managed investments (international stocks, real estate, hedge funds) in hopes of achieving higher returns.

 

City Treasurer Joey Greive said that the General Employees Pension Plan management expenses are very good in comparison with other funds in the $1 – 5 billion asset range. Beth McCague, interim Executive Director of the PFPF, said that the board has a meeting next week with its financial advisor to discuss strategy and will look at moving more assets from actively managed funds to lower cost index funds. She noted that the fund’s management expenses have been artificially inflated in the past several years by high legal fees for several lawsuits and by costs associated with pension reform legislation (i.e. several actuarial studies). Ms. McCague also cautioned that using a totally integrated company like BPAS (encompassing all pension-related functions from actuarial analysis to investment management to banking services) could be risky.

 

Chairman Gulliford indicated that he wants to hear from the General Counsel’s Office about whether the City might have a cause of action to recoup funds paid out to former City Finance Director Ronnie Belton when he converted his retirement from the defined benefit to the defined contribution plan upon his departure from city government. He believes that action violated Mr. Belton’s fiduciary responsibility as a manager of the pension fund.

 

Next, John McCarthy, JEA’s chief procurement officer, made a presentation on the City’s recent procurement disparity study and the activities of the Supplier Diversity Joint Agency Task Force. The task force is a cooperative effort of the procurement divisions of the City, Jacksonville Transportation Authority, JEA, Jacksonville Aviation Authority, Jacksonville Port Authority and the Duval County Public Schools to assist small, minority and disadvantaged businesses in accessing public contracting opportunities. Among them the various agencies have a number of business diversity assistance programs, some race- and gender-targeted and another (the City’s JSEB program) being race and gender neutral and aimed at all small and emerging businesses. The Joint Task Force is engaging in a number of training and outreach activities to assist small businesses in connecting both with public contracting opportunities and with majority-owned general contractors. Council Member Boyer noted that the City’s JSEB program contained a 13-year participation limit on businesses and noted that the 13th anniversary of the creation of the program is approaching. She suggested that the Joint Agency Task Force discuss at a future meeting what that may mean for businesses that have been in the JSEB program since its inception.
