Bill Summary

 

Bill Scheu of the Police and Fire Pension Fund board of trustees reported that the fund is working with Council Member Brosche’s subcommittee on subpoenaed documents and will be providing additional information as requested at the last meeting. The PFPF has authorized third parties (investment managers) to provide information to the City upon request. He also reported that the PFPF board has appointed a committee on legal services and, in conjunction with the Office of General Counsel, will be issuing an RFP for legal services for the fund. Finally, former Executive Director John Keane’s consulting agreement expired on January 31st and will be extended to February 29th at a maximum of 24 hours per week as Mr. Keane assists the interim executive director in the transition process. Chief Assistant General Counsel Stephen Durden explained that this bill and 2015-683 clarify that the employees of the PFPF have two retirement plan options – the City’s General Employees Pension Plan or the City’s defined contribution plan. Council Member Boyer requested absolute assurance that 2015-422, 2015-683 and the settlement agreement agreed to by  the City, Mr. Keane and the PFPF are all in complete agreement as to terms.

Bill Summary  

 

Council Member Boyer expressed strong disagreement with a characterization of her remarks in a previous meeting that implied she believed the voters were incapable of dealing with numerous issues on a long ballot. Her point in that meeting was that placing this referendum on the November presidential election ballot runs the risk that the term limit issue will be swamped by presidential politics and garner little or no notice from the general public. A vigorous campaign will need to be waged for the public to understand this proposal if there is any chance for it to be approved which could be difficult in the context of the presidential race. She believes that the sales tax extension for pension liability amortization referendum should be the City’s top priority and the term limits extension should not be placed on the same ballot so as to allow the City to concentrate all its promotional efforts on one referendum at a time.

 

Property Appraiser Jerry Holland and Tax Collector Michael Corrigan provided perspective on term limits in their capacities as current constitutional officers and former City Council members. Finance Director Mike Weinstein said that the administration’s preference would be to have the sales tax extension referendum on the August primary ballot rather than the November presidential ballot, but that the November date is more likely given the timing of action by the Legislature.

 

Council Member Crescimbeni moved an amendment to make the 3-term limit effective beginning with candidates running for their first term in 2019 so as to exclude any council member elected while the 2-term limit was in effect from being eligible for a third term; the amendment failed 2-5

Council Member Crescimbeni moved an amendment to provide that the referendum in 2016 would be a straw ballot; the amendment failed 1-6.

FSCJ President Cynthia Bioteau thanked the committee for its support of this initiative and several committee members thanked the President for FSCJ’s contributions to the Jacksonville community. In response to a question, Assistant Council Auditor Kyle Billy stated that the City funding from the Historic Preservation Trust Fund would be expended only on eligible historical elements and would be provided on a reimbursement basis after the college expends the funds and makes the renovations. Tom Daly of the Downtown Investment Authority said that the building would be subject to 2 inspections, one by the DIA when construction is complete and the other by the Historic Preservation section of the Planning and Development Department to verify compliance with historic preservation regulations.

At the conclusion of the meeting Council Auditor Kirk Sherman made a presentation on his office’s review of the FY14-15 budget wrap-up after the year-end closeout. Total revenues were $3.2 million short of budget, due in large part to a $6.1 million shortfall in Fire and Rescue Department EMS billings and collections and $7 million in Banking Fund borrowing that was not accomplished during the fiscal year, offset by better-than-budgeted collections of ad valorem taxes ($2.3 million) and state-shared sales tax revenue ($6.18 million). Expenditures came in $12.2 million under budget, led by a large favorable variances in the Sheriff’s Office budget of $6.6 million and the Supervisor of Elections’ office of $1.27 million. A total of $2.17 million in unspent appropriations is being swept into an unappropriated reconciliation fund after negative cash balances in numerous accounts are filled by fund transfers.

 

Jon Heymann, Executive Director of the Jacksonville Children’s Commission, explained the reason for the Commission’s $1.14 million year-end fund balance, which is mostly attributable to the fact that changing demographic conditions in field (substantial increases or decreases in the number of young people being served by various Commission-funded programs at various sites) cannot be dealt with by administrative transfers of funds from low-attendance sites to high-attendance sites. City Council action to approve revised contracts with the agencies reflecting different attendance parameters are required and sometimes are not accomplished within the grant year.

 

Council Member Brosche updated the committee on the work of her subcommittee to review the records subpoenaed from the Police and Fire Pension Fund and from Robert Klausner, the fund’s attorney. The subcommittee has met twice with the PFPF’s board chair, interim executive director and comptroller and efforts are underway to answer all of the subcommittee’s questions about the documentation received. Ms. Brosche and Council Auditor Kirk Sherman are developing a list of questions to be sent to Mr. Klausner for a response. Ms. Brosche thanked the subcommittee and the staffs of the PFPF and Council Auditor’s Office for their hard work and cooperation to date.
