The Committee shall consider land use and zoning matters, including zoning; preservation; conservation; building codes; urban renewal; real estate; land use; land, water and wetlands preservation; water supply issues; comprehensive planning; strategic planning; current planning; growth management and implementation of state statutes regarding same; Planning and Development Department; appeals from Planning Commission decisions; growth management; transportation concurrency and mobility; school concurrency; monitoring and implementation of the new State growth management laws; actively participate in amending and updating Jacksonville's Comprehensive Plan, including reviewing all text amendments and Future Land Use Map Amendments to the comprehensive plan; and all related subjects.

 

If a person decides to appeal any decision made by the Council with respect to any matter considered at such meeting, such person will need a record of the proceedings, and for such purpose, such person may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.

During discussion, CM Bowman stated he did not support the bill. Since October 1, 2015, there have been 54 non-compliance cases on the property of which 33 are still opened.  He commented that the PC conditions were not sufficient to address the overall problems: 50’ lots which are not consistent with the area, parking, comparable access for delivery services, and road congestion.  CM Bowman responded that he thought RLD60 was more appropriate rather than the PUD. In response to CM Ferraro’s question, Mr. Sanders stated OGC informed him that the open violations were being held until after the rezoning process.

 

Ms. Grandin briefed the committee on competent substantial evidence to as it relates to the PC recommendation and information provided by the agent. In addition, she explained that conditions of a PUD could not circumvent the Code. Mr. Sanders requested a deferral to meet with CM Bowman and discuss options. CM Bowman stated it may be necessary to have a community meeting.

 

The PH was re-opened and continued to 12/6/16.
