LUZ Special Committee Meeting Minutes

September 7, 2016

4:45 p.m.

 

Topic: System processes for zoning and land use matters

 

Location: City Council Chamber, 1st floor, City Hall – St. James Building, 117 West Duval Street

 

In attendance: Council Members Danny Becton (Chair), Jim Love, Doyle Carter, Al Ferraro, Reggie Gaffney

 

Also: Kristen Reed and Bruce Lewis – Planning & Development Department; Susan Grandin – Office of General Counsel; Jessica Matthews – Legislative Services Division; Dan MacDonald – ECA Dist. 11;

 

Meeting Convened: 4:56 p.m.

 

Chairman Becton called the meeting to order.

 

Chairman Becton stated Mr. Bruce Lewis and Ms. Kristen Reed would present on the timeline of applications for all types of zonings and land use matters. Ms. Reed shared there are three processes related to the comprehensive plan, and five related to rezoning. The committee received a handout which detailed the various process flowcharts to include timelines (estimates) based on optimal application provided there are no complications.

 

The three processes related to the comprehensive plan include: Notice of Proposed Change (NOPC)/Amendment to a DRI; Large Scale Land use; and Small Scale Land Use Amendment. CM Gaffney voiced his concern that district members are not informed about proposed legislation during draft section rather after introduction. It was suggested that an additional step is implemented to notify Council members earlier of pending legislation earlier their district.

 

Ms. Reed explained that a DRI is a large scale development with regional impact. Large Scale Land Use Amendments are ten acres or larger, and include text amendments of any size are considered with the large scale amendment, unless it is site specific to a small scale. A small scale amendment cannot be moved unless filed concurrently with the zoning. Both scale amendment processes include citizen information meetings; public notice; and Planning Commission and LUZ public hearings prior to final hearing before the entire Council.

Ms. Reed provided a brief summary of the Historic Preservation Certificate of Appropriateness (COA) which is exterior alterations to historic significant building in historic districts or buildings throughout the City that have been landmarked.

 

The next special meeting will continue with the timeline for the rezoning processes.
