LUZ Special Committee Meeting Minutes

August 2, 2016

4:45 p.m.

 

Topic: Appeal Hearing 2016-315

 

Location: City Council Chamber, 1st floor, City Hall – St. James Building, 117 West Duval Street

 

In attendance: Council Members Danny Becton (Chair), Jim Love, Doyle Carter (4:49 arr.), Al Ferraro, Reggie Gaffney, Joyce Morgan, Matt Schellenberg

 

Also: Joel McEachin and Kristen Reed – Planning & Development Department; Susan Grandin – Office of General Counsel; Yvonne P. Mitchell  – Council Research Division; Jessica Matthews – Legislative Services Division; Dan MacDonald – ECA Dist. 11;

 

Meeting Convened: 4:46 p.m.

 

Chairman Becton called the meeting to order.

 

Ex Parte: Love, Schellenberg, Ferraro, Becton, Carter, Gaffney

 

Ms. Susan Grandin reviewed her memorandum regarding hearing procedures, motions, and the criteria for decision. Mr. Jason Teal began with discussing the parameters of the hearing and Jacksonville Historic Preservation Commission’s (JHPC) position. Mr. Steve Diebenow, for appellant, was given 20 minutes for his presentation. He called John Bamping, Rob Zinn, Ben Campen, Fred Podris, and Kevin Dougherty as witnesses. The public hearing was opened and closed. Mr. Teal was provided 20 minutes for his presentation and called Joel McEachin and Tom Goldsbury as witnesses. Afterwards, Mr. Diebenow was allowed five minutes for rebuttal.

 

The committee deliberated and determined whether the case was an administrative res judicata. Based on the competent, substantial evidence, the minor modification was necessary due to the inability to properly correct the slope of the roof. The issue was not noticed until work began on the roof. The hip roof could not be connected to the valley flashing. Therefore, the project would not receive a warranty from the roofer.

 

Motion/2nd move to determine no Administrative Res Judicata due to substantial change in circumstances and grant appeal – Schellenberg/Carter (7-0)
