Chairman Becton called the meeting to order.
Ex Parte: Love, Schellenberg, Ferraro, Becton, Carter,
Gaffney
Ms. Susan Grandin reviewed her memorandum regarding hearing
procedures, motions, and the criteria for decision. Mr. Jason Teal began with
discussing the parameters of the hearing and Jacksonville Historic Preservation
Commission’s (JHPC) position. Mr. Steve Diebenow, for appellant, was given 20
minutes for his presentation. He called John Bamping, Rob Zinn, Ben Campen,
Fred Podris, and Kevin Dougherty as witnesses. The public hearing was opened
and closed. Mr. Teal was provided 20 minutes for his presentation and called
Joel McEachin and Tom Goldsbury as witnesses. Afterwards, Mr. Diebenow was
allowed five minutes for rebuttal.
The committee deliberated and determined whether the case
was an administrative res judicata. Based on the competent, substantial
evidence, the minor modification was necessary due to the inability to properly
correct the slope of the roof. The issue was not noticed until work began on
the roof. The hip roof could not be connected to the valley flashing. Therefore,
the project would not receive a warranty from the roofer.
