The committee has two options: rescind original ordinance or amend the proposed legislation which must remain in substantial form of the agreed settlement.  Some of the regulations of the proposal include: donation bins must have a current Certificate of Use; and bins must be located on occupied properties not to include parking lots. Council members commented on concerns about lack of specific allowable zoning districts; vague definitions; setback requirements and clarification of enforcement authority.

 

Public hearing opened. One speaker: Patrick Krechowski (support) represents Go Green and has worked with Mr. Teal in drafting the proposed legislation. He stressed that solicitation of charitable donations is a form of protected speech. He suggested that all stakeholders are included in the creation of a new ordinance to ensure proper regulation of collection bins. Mr. Krechowski agreed to attend NICE meetings and participate in the process.

 

CM Crescimbeni recommended the committee repeal the original legislation and allow the NICE committee an opportunity to work on regulation.
