Council Member Gulliford answered questions about the intent of his bill. Council Member Love asked for clarification about the implications for other types of electronic communications (Facebook, LinkedIn, etc.). The committee discussed the merits of enacting an ordinance versus asking the Council President to amend his announced policy. Mr. Gulliford stated that he may challenge the President’s ruling on this issue and ask for a Council vote to overturn the policy.

City Treasurer Joey Greive and Assistant General Counsel John Sawyer made a presentation to the committee and answered questions about the recent media reports concerning members of past-Mayor Brown’s administration qualifying for City retirement benefits despite having less than the 5 years of City employment required to vest such benefits. Mr. Greive gave an overview of the operation of both the defined benefit and defined contribution retirement plans and explained the Code provisions that allow participants to switch back and forth between plans several times at different points in their City employment. Some of the provisions are in conflict with each other and that situation needs to be rectified. He explained that the employee’s age at the time of the separation from service has a big impact on the conversion calculation, with older employees getting a more favorable conversion amount from their employee contribution to the defined benefit plan to the defined contribution plan. Mr. Greive reported that the board of the General Employees’ Pension Plan has temporarily suspended conversions between the plans while the Finance Department and General Counsel’s Office investigate potential changes to the system.

 

John Sawyer explained that a practice in which the City has consistently engaged over time, even if it is not specifically authorized by the Code or by a collective bargaining agreement, may become a matter that must be collectively bargained in order to change because it has by default become the standard practice. Mr. Greive stated that since the City has not engaged in collective bargaining with its unions since 2012, there has been no opportunity to address the “past practice” problem with retirement system conversions. The GEPP board will be meeting on February 25th, at which time Mr. Sawyer will present the results of his research and will make recommendations to the board.
