There was a lengthy discussion on this item.

 

Attorney Steve Diebenow, agent for the applicant, reported to the Committee that at the suggestion of the Committee Chair at a previous TEU Committee meeting, he and the Owner of Florida Roads Clean Concrete Recycling Facility, Rick Baker, had twice met with the neighbors whose homes abut the facility to hear their concerns.  TEU Chair, Council Member Al Ferraro, attended the meetings, as well. To resolve some of the concerns raised at the meetings, Mr. Diebenow referred to Exhibit 1, the Specific Operating Conditions, where he noted that Florida Clean Roads agreed to lessen the number of hours that the concrete crushing machinery would be operating and that the company agreed that the crusher would be positioned and operated within 450 feet of the eastern property boundary line.  To meet the neighbors’ concerns about traffic, it was agreed that the facility would install speed bumps and/or an entry gate at the entrance of the facility.

 

A number of people whose home and property abut the concrete facility made comments that raised numerous concerns about the facility.  Those concerns included ash in the air, toxicity, potential groundwater contamination, traffic and other issues.  The speakers fielded a number of questions from the Committee members.

 

In the course of the discussion, Mr. Diebenow indicated that Florida Roads would accept an amendment that barred bringing any materials from out-of-state to the facility

 

Eric Fuller, Solid Waste Division, Public Works Department, clarified various components of the Certificates of Convenience and Necessity (CON).  It has to be renewed every five years.  Facilities must provide Solid Waste with monthly reports.  In answering an inquiry of Council Vice President John Crescimbeni, it is likely that the Administration will offer revisions to Chapter 380 which would eliminate the current process for CON application and approval; the change would eliminate the City Council’s role and have the process handled administratively.
