(Amend Chapt 30 (Planning and Dev Dept), Ord Code, to Clarify that a Quorum is required for any action taken by the Planning Commission):

 

Rules: Provides that a quorum shall consist of 6 members or duly appointed alternates; the concurrence of a majority of 6 or more of the members and duly appointed alternates (minimum 4 votes) shall be required before any report or recommendation is made or action taken by the commission.

 

LUZ: Provides that a concurrent vote of at least 5 Commission members is required to act on an item.

Amendment

(Rezoning AC Skinner Pkwy btwn I-95 and Southside Blvd from IBP & CO to PUD): Per OGC, approves rezoning subject to conditions:

(1)        The developer shall comply with comments from Traffic Engineering received on August 21, 2018 regarding traffic flow and access: (a) Provide a traffic study to determine the need for signalization and a right turn lane at the entrance, the length of the deceleration lane shall be based on the design speed of AC Skinner Parkway in accordance with FDOT design standards. The queue length, if needed, shall be determined by the traffic study; (b) There are currently no median openings in this part of AC Skinner Parkway. A left turn lane shall be required at the proposed median opening. The length of the left turn lane shall be based on the design speed of AC Skinner Parkway in accordance with FDOT design standards. The queue length shall be a minimum of 100 feet, or longer, if determined by the traffic study; (c) The existing median trees shall be removed where needed for driver visibility. The developer shall comply with appropriate landscape regulations for tree mitigation; and (d) If the site is to be gated, the developer shall provide a queuing study and ensure that at no time shall queuing vehicles extend into the City right of way.

(2)        The developer shall comply with the memo from the Transportation Planning Division regarding Part 6 requirements for bicycle parking.

(3)        Prior to the first final inspection within any phase of development, the owner or their agent shall submit to the Planning and Development Department for its review and approval either (a) an affidavit documenting that all conditions to the development order have been satisfied, or (b) a detailed agreement for the completion of all conditions to the development order

Amendment

(Rezoning 8050 Baymeadows Cir W btwn Cypress Green Dr & Linkside Dr from CCG-1 to PUD): Per OGC, approves rezoning subject to conditions:

(1)        In the event that a community sign substantially similar to the sign depicted on Exhibit 5, attached hereto, located in the median of Baymeadows Circle West, adjacent to Baymeadows Road, that includes signage for the Subject Property is not permitted by the City of Jacksonville within four (4) months after the date of approval of this PUD, the Subject Property shall be allowed signage on the sign parcel with R.E. No. 152699-0055, which is not a part of the PUD, pursuant to a permitted transfer of sign rights in accordance with Section 656.1320 of the Zoning Code.  In any event, the Subject Property shall be permitted the signage as set forth in Section III (F) of the Revised Written Description attached hereto as Revised Exhibit 3.

(2)        The architectural features, landscaping and similar improvements on the Subject Property shall be substantially similar in quality and finish to the improvements shown on Exhibit 6, attached hereto, which represents other redevelopment projects completed by the applicant. Also, as shown on the Site Plan and Landscape Plan, attached hereto as Exhibit 4, recreational facilities shall include a club house, pool, fitness center, tennis court, dog walk and other related amenities.

(3)        Pursuant to the recommendations outlined in the Southeast Vision Plan and the Baymeadows Community Plan, the applicant shall provide a sidewalk along Cypress Green Drive, adjacent to the Subject Property from Baymeadows Circle West terminus. This requirement shall not apply in the event that (a) the Baymeadows Improvement Special Taxing District (or similar special taxing district) encompassing the Subject Property and adjacent developments along Cypress Green Drive is formed by January 1, 2021, and (b) said special taxing district includes a capital improvements plan that provides for sidewalks along the entire length of Cypress Green Drive by January 1, 2024, provided that any such failure to provide for sidewalks within such capital improvements plan must be in good faith.

(4)        The existing pole sign on the Subject Property shall be removed.

(5)        Pursuant to Policy 4.1.5 of the Transportation Element of the 2030 Comprehensive Plan, the applicant shall provide for the convenient and safe access by, and securing of, bicycles on site. The bicycle parking shall be consistent with the requirements outlined in Part 6 of the Zoning Code.

(6)        Prior to the first final inspection within any phase of development, the owner or their agent shall submit to the Planning and Development Department for its review and approval either (a) an affidavit documenting that all conditions to the development order have been satisfied, or (b) a detailed agreement for the completion of all conditions to the development order

(Rezoning 0 Garden St. btwn Jones Rd and Helmsdale Dr. from PUD to PUD): Per OGC, approves rezoning subject to conditions:

(1)        Prior to development of the Subject Property, documentation of a completed gopher tortoise burrow survey and proof of subsequent relocation efforts to be performed by an authorized gopher tortoise agent, per Florida Fish and Wildlife Conservation Commission regulations, shall be provided to the Planning and Development Department.

(2)        Prior to the first final inspection within any phase of development, the owner or their agent shall submit to the Planning and Development Department for its review and approval either (a) an affidavit documenting that all conditions to the development order have been satisfied, or (b) a detailed agreement for the completion of all conditions to the development order.

(Amending various Ordinance Code provisions re: CRA powers, duties and budgets):

1.      Requires a uniform budget format for all CRA budgets

2.      Creates a new Subpart D in Chapter 106, Part 3 – Appropriations for Community Redevelopment Agencies

3.      Authorizes CRAs to allocate and transfer funds within Plan Authorized Expenditure Categories without prior Council approval in accordance with Council-adopted CRA plans and within CRA boundaries, subject to certain requirements

4.      Authorizes CRAs to allocate and transfer funds between CRA Budget Categories without prior Council approval in accordance with Council-adopted CRA plans and within CRA boundaries, subject to certain requirements

5.      Establishes a CRA board approval process for budget allocations and transfers permitted under the new Subpart D

6.      Appropriates additional CRA Trust Fund revenues received in the amount not to exceed $100,000 without further Council approval

7.      Amends existing CRA trust funds (DIA and Renew Arlington) and creates new CRA trust funds for JIA CARA and KingSoutel CRA that provide for carry-over from fiscal year to fiscal year, require trust funds to be deposited and accounted for in separate interest bearing accounts (with interest remaining in the trust fund), and providing for any remaining trust funds at the end of a fiscal year not already encumbered or allocated to an activity that carries over be returned to the General Fund (except in the case of the DIA, which funds are deposited in an account for downtown economic development).

8.      Clarifies provisions in Chapter 500 to be consistent with the provisions of the new Subpart D and grants the mayor the authority to execute all contracts and documents approved by the CRA.
