Amendment

(Waiver of Minimum Rd Frontage Appl WRF-17-27 at 7362 Townsend Rd): Per OGC, approves waiver subject to conditions:

1.         If the land is ever subdivided, the access to the property shall be brought up to City standards. A document so stating, approved by the Office of General Counsel, shall be filed in the Public Records of Duval County.

2.         The property owner shall be responsible for naming the driveway access according to the Standards of the Planning and Development Department’s Addressing Section.

3.         Prior to the first final inspection within any phase of development, the owner or their agent shall submit to the Planning and Development Department for its review and approval either:

a)         An affidavit documenting that all conditions of the development order have been satisfied, or

b)         A detailed agreement for the completion of all conditions of the development order.

Inserts a new Section 5 - Applicant Acknowledgement – in the bill to reflect that the applicant acknowledges assuming risk on the future use of the east/west easement.

(Amend Zoning Code Sports & Entertainmt Complex Sign Overlay Zone to Auth Advertisemts in the Sports & Entertainmt Complex relating to a Promoter or Sponsor of Events on digital signs): includes a provision in the bill acknowledging that no more than 30% of the total cost of the sign will come from the Audio /Visual project account within the Arena/Baseball portion of the Sports Complex Capital Maintenance Fund.

  c. Identify $240,320 for future allocation

(Rezoning properties on Kings Ave, Bertha St, Mitchell Ave, Olevia St & Perry Place from CCG-1, CCG-2 & CO to PUD): Per OGC, approves rezoning subject to conditions:

1.         For apartment units, parking will be provided at a minimum of 1.30 parking spaces per one (1) bedroom dwelling unit and a minimum of 1.5 parking spaces per two (2) or more bedroom dwelling units.  In the event that more than fifty (50) percent of the apartment units, in the aggregate, contain two (2) or more bedrooms, a PUD amendment (rezoning) will be required to address the parking requirements herein.

2.         Prior to the first final inspection within any phase of development, the owner or their agent shall submit to the Planning and Development Department for its review and approval either:

a)         An affidavit documenting that all conditions of the development order have been satisfied, or

b)         A detailed agreement for the completion of all conditions of the development order.

Attaches Revised Exhibit 3 (revised written description).

(Rezoning 1183 Edgewood Ave S from CCG-1 to PUD): Per OGC, strikes “FOR THE SALE AND SERVICE WITHIN THE BUILDING OF BEER, WINE, CIDER AND MEAD” from the bill title; attaches Revised Exhibit 3 (Revised Written Description removing all uses by exception); attaches Revised Exhibit 4 (Revised Site Plan adding a conceptual floor plan for seating).

(Appeal of Final Decision of Jax Historic Preservation Comm Denying the Application for Certificate of Appropriateness to Apv a Rear Addition & Reconstrn of the Garage at 1776 Challen Ave): Per OGC, grants the appeal and reverses the decision of the Historic Preservation Commission regarding the overall massing and scale of the proposed addition; allows Planning Department administrative review of materials, door and window placement, and other elements regulated by Chapter 307.

(Approp $150,000 from Fund Balance to the Operating Lease Acct to fund Repair & Renovation Expenses at the Beaches Branch of the Clerk of Courts in Tradewind Plaza):

1. Revise on file document with lease approved by MBRC

2. Clarify funding source is Clerk of Court’s fund balance

3. Clarify funding is for operating lease – leasehold improvements

4. Add language to title and bill that states that the flat rate for operating expenses increases to $6.00/SF for the renewal period
