17-478

Amendment

(Admin Deviation at 1596 Gately Rd to Reduce Minimum Lot Area): Per OGC, deviation approved subject to condition:

As a condition of approval of the lot size reduction for the land shown in Revised Exhibit 2 of this ordinance, the owner agrees that neither the adjacent property located at 1600 Gately Road, Jacksonville, Florida 32225 and contained in Real Estate #161021-1100, also owned by the applicant, as well as the Subject Property will not be eligible to make a future request for a reduction in lot size to less than allowed by the zoning district, or a reduction in road frontage, unless such request is pursued through a rezoning.  To that end, a Declaration of Restrictive Covenant, in substantially the same form as attached hereto as Exhibit 3, dated January 11, 2018, shall be executed by the applicant and filed in the Duval County public records.  A copy of the recorded document shall be provided to the Planning and Development Department within 30 days of the approval of this Deviation.  The Department is directed to place a Hold, or to request that the Building Inspection Division place a Hold, on 1600 Gately Road to prohibit future requests for a reduction in lot size to less than that allowed by the zoning district in which it is located.  The term “Hold” is as utilized within the Building Inspection Division’s permitting system.”

Amendment

(Rezoning Propty near NW Quadrant of Kernan Blvd & J Turner Butler Blvd from CO to PUD): Per OGC, rezoning approved subject to conditions:

1. The subject property shall be developed in accordance with and subject to the following comments from the City’s Traffic Engineering Division:

a.         A northbound left turn onto Kernan Blvd S. at the signalized intersection is required.

b.         Signal modification plans should be included in the 10-set review.

c.         Alleys will not be maintained by the City.

2. The subject property shall be developed in accordance with and subject to the following comments from the City’s Transportation Planning Division:

a.         Sidewalks must be constructed along Kernan Boulevard south of First Coast Tech Parkway, and must be integrated into the proposed pedestrian circulation system, including a crosswalk along the ingress/egress point at First Coast Tech Parkway.

b.         Sidewalks must be constructed along Betty Holzendorf Drive along the property frontage and integrated into both the existing and proposed pedestrian circulation systems.

3. A traffic study has been submitted by the applicant and is under review by the City Traffic Engineer. The final design of the proposed access improvements shall be subject to review and approval of the City Traffic Engineer prior to final 10-set review.

4. Prior to the first final inspection within any phase of development, the owner or their agent shall submit to the Planning and Development Department for its review and approval either (a) an affidavit documenting that all conditions to the development order applicable to that phase have been satisfied, or (b) a detailed agreement for the completion of all conditions to the development order applicable to that phase.

(Amend Chapt 37 - Ofc of the Sheriff – to reorganize certain departments): reduces the number of proposed new Assistant Chiefs by 1 to 22; attaches organizational chart.

(Amend Mobility Fee Zone Spec Rev Fund to Specify that the Mobility Fee is to be Placed into the Acct corresponding with the Mobility Zone in which the Dev will occur): corrects formatting pg. 3, line 31 “The”; corrects section reference pg. 4, line 11; adds a requirement that the plan be updated within one year following adoption of the North Florida TPO Plan and no less than once every 10 years.

Amendment

(Rezoning 17110 Brandy Branch Rd from AGR & CCG-1 to PUD): Per OGC, rezoning approved subject to conditions:

1.         Ground Signage along New Brandy Branch Road shall be limited to one (1) monument-style sign, not to exceed twenty (20) feet in height.

2.         All sag lenses, drop lenses and convex lenses shall be prohibited.  Illumination levels at all property lines shall not exceed one-half (.5) foot candles (“f.c.”) when the building or parking areas are located adjacent to residential areas, and shall not exceed one (1.0) f.c. when abutting other non-residential properties.  All lighting lamp sources within parking and pedestrian areas shall be metal halide, compact fluorescent or LED.  The maximum light pole height in all parking areas should not exceed thirty (30) feet.  An exterior lighting design plan, including a photometrics plan, pole and fixtures schedules shall be submitted at the time of Verification of Substantial Compliance for review and approval by the Planning and Development Department.

3.         The developer shall mount light fixtures on canopies so that the lens cover is recessed or flush with the bottom surface (ceiling) of the canopy.

4.         Along the western property line an eight (8) foot high, 100% opaque vinyl fence and an evergreen screen consisting of 2.5 inch caliper, 25 gallon, Florida No. 1 tree spaced 10 feet on center, shall be planted.  Permitted trees include Southern Magnolia, Magnolia grandiflora; Southern Red Cedar, Juniperus silicola; Nellie Stevens Holly, Ilex ‘Nellie R. Stevens’ and Leyland Cypress, Cupressocyparis leylandii.

5.         Along the northern property line for a distance of 500 feet from the west property line excluding any driveway openings, (fence and trees shall be setback 15 feet from the right of way) an eight (8) foot high, 100% opaque vinyl fence and an evergreen screen consisting of 2.5 inch caliper, 25 gallon, Florida No. 1 tree spaced 10 feet on center, shall be planted along the northern property line. Permitted trees included Southern Magnolia, Magnolia grandiflora; Southern Red Cedar, Juniperus silicola; Nellie Stevens Holly, Ilex ‘Nellie R. Stevens’ and Leyland Cypress, Cupressocyparis leylandii.

6.         Prior to the first final inspection within any phase of development, the owner or their agent shall submit to the Planning and Development Department for its review and approval either:

a)         An affidavit documenting that all conditions of the development order have been satisfied, or

b)         A detailed agreement for the completion of all conditions of the development order.

(ORD Approp $687,000 from Tourist Dev Council Contingency Acct for 1-time Funding to Jacksonville Zoological Society for African Forest Exhibit Advertising/Promotion): adds 3conditions to the funding contract: 1) one-fourth of funds shall be distributed at the end of each quarter; 2) the final $50,000 payment is contingent upon opening of the African Exhibit; 3) if year-end financial audit shows less than total City funding is spent, difference is to be returned to the City of Jacksonville.

(Auth 1st Amend to Franchise Agreemt with Buckeye Terminals): corrects combined fee amounts for first and last year in bill; clarifies that initial fee for FY 2017/18 and final fee for FY 2037/38 in bill is for both pipelines; attaches Revised Exhibit 1 (revised agreement) to identify Revised Exhibit A and show first payments are for FY 2017/18.

(Auth Economic Dev Agreemt with Project Volt, including QTI and REV grant):

Reduces average salary figure to $45,562; removes “over” since salaries are at 100%; attaches Revised Exhibit 1 (revised project summary); replaces On File agreement with Revised On File agreement incorporating the following changes:

   a) Include address and RE# of project parcel

   b) Remove reference to Metropolitan Statistical Area

   c) Correct JSEB 5% participation requirement to $1,230,000

   d) Add JSEB clarification that Company has sole discretion in determining vendors and subcontractors

   e) Change term “capital” investment to “project” investment

   f)  Allows company to receive incentives from its landlord related to existing buildings if any are in place

   g) Revise QTI-related language to more closely align with the State Agreement
