Amendment

(ORD-Q Apv Waiver of Minimum Rd Frontage Appl WRF-18-15 at 11160 Scott Mill Rd from 80' to 0' in RLD-120): approves the waiver subject to conditions:

(1) Upon the purchase of the subject property, the Grant of Easement will be issued in the name of the new owner.

(2) Access to the subject property shall be sufficient to accommodate emergency vehicles.

Substitute

(Amend Chapt 602, Ord Code (Jacksonville Ethics Code), Part 2 (Definitions) Sec 602.201 (Definitions), Part 7 (Gifts & Honoraria), Sec 602.701 (Prohibited Receipt of Gifts), 602.702 (Prohibited Offering of Gifts), 602.703 (Receipt or Charge of Commissions or Gifts for Official Transactions), and 602.704 (Honoraria), Ord Code): as substituted:

1.      Revises definitions by deleting “advisory body”, “controlling interest”, “fair market value”, “governmental action”, “honorarium”, “immediate family member”, “material interest”, “permitting employee”, “procurement employee”, “reporting individual” and “zoning employee”; adding definitions of “agency” and “vendor”; and revising the definitions of “executive branch department” and “independent agency”.

2.      Clarifies provisions regarding prohibited gifts and eliminates references to “honoraria”. Deletes the language prohibiting certain employees and officials from accepting individual gifts valued at over $100 or gifts cumulatively valued at over $250 in a year.

3.      Requires City Council, city departments, constitutional officers and independent authorities to develop gift policies relevant to their agency operations, emphasizing analysis of risk, maximum transparency and minimal acceptance of gifts.

4.      Corrects the name of the Ethics, Compliance and Oversight Office in several places.

5.      Adds new provisions governing acceptance of fees for speeches, speaking and writing articles.

6.      Creates a new section to regulate gifts to the City, including required designation of mayoral, City Council and independent agency representatives authorized to accept, register, distribute and report on gifts made to their agencies.

7.      Adds a new Penalties section providing that first allegations of violations of the chapter shall be handled by the Employee Services Department of the City or equivalent department or ethics office of the constitutional offices and independent agencies. Those offices may refer cases to the Ethics Commission for review. Any second or subsequent allegations of violations must be filed as complaints to the Ethics Commission. Provides that in addition to any penalties prescribed by law, the City, constitutional officer or independent agency shall be entitled to recover from an officer or employee found guilty of a violation the amount of the fee, commission, gift, gratuity, loan, or other consideration, which may be imposed as a fine by the circuit court or by the Ethics Commission. The City, constitutional officer or independent agency may file a civil action to pursue those funds.

Amendment

(Rezoning 0 Western Way btwn Southside Blvd & I-95 from IBP to PUD): rezoning approved subject to conditions:

(1)               The development shall comply with Section 656.420 of the Zoning Code and Policy 2.2.5 of the Recreation and Open Space Element of the 2030 Comprehensive Plan.  Active recreation area shall be provided at a rate of 150 square feet per dwelling unit.

(2)               Amend Part F. Parking and Loading Requirements of the written description. “The PUD may provide for more parking than is required, subject to review and approval by the Planning and Development Department.”

(3)               The development shall be subject to mobility fee review.

(4)               Pursuant to Policy 4.1.5 of the Transportation Element of the 2030 Comprehensive Plan, the applicant must provide for the convenient and safe access by and securing of bicycles on site. The bicycle parking must be consistent with the requirements outlined in Part 6 of the Zoning Code.

(5)               Prior to the first final inspection within any phase of development, the owner or their agent shall submit to the Planning and Development Department for its review and approval either (a) an affidavit documenting that all conditions to the development order have been satisfied, or (b) a detailed agreement for the completion of all conditions to the development order.

Amendment

(Rezoning 1828, 1924, & 1939 Bertha St; 1817, 1821, 1831 Mitchell Ave; 2217 Perry Place  btwn Perry Place & Kings Ave from CO/CCG-2/PUD to PUD): rezoning approved subject to conditions:

(1)               The development shall be subject to the Traffic Engineering recommendations dated December 21, 2018, or as otherwise approved by the Planning and Development Department.

(2)               For apartment units, parking will be provided at a minimum of 1.30 parking spaces per one (1) bedroom dwelling unit and a minimum of 1.5 parking spaces per two (2) or more bedroom dwelling units. In the event that more than fifty (50) percent of the apartment units, in the aggregate, contain two (2) or more bedrooms, a PUD amendment (rezoning) will be required to address the parking requirements herein. For townhomes, parking will be provided at a minimum of 1.5 parking spaces per dwelling unit.

(3)               Prior to the first final inspection within any phase of development, the owner or their agent shall submit to the Planning and Development Department for its review and approval either (a) an affidavit documenting that all conditions to the development order have been satisfied, or (b) a detailed agreement for the completion of all conditions to the development order.

(1)        Provide a left turn lane meeting FDOT standards on Panther Creek Parkway at the proposed road. Ensure there is adequate visibility around the curve in the vicinity of Royal Dornoch Drive for vehicles turning left.

(2)        The posted speed limit on the street shall not exceed 25 miles per hour (mph) subject to the review and approval of the City’s Traffic Engineer.

(3)        Prior to the first final inspection within any phase of development, the owner or their agent shall submit to the Planning and Development Department for its review and approval either (a) an affidavit documenting that all conditions to the development order have been satisfied, or (b) a detailed agreement for the completion of all conditions to the development order

(Rezoning East of Catherine St, South of East Bay St & Gator Bowl Blvd & North of the St. Johns River & NE of the Intersection of Gator Bowl Blvd & Georgia St from PBF-1/ROS/PUD to CCBD): inserts a provision that the rezoning of Metropolitan Park shall not become effective until the City Council approves  a redevelopment agreement including  Metropolitan Park, and the conversion of the Land, Water and Conservation Fund Grant land from public outdoor recreation to another use has been approved by the National Park Service as evidenced by an Amendment to Project Agreement 12-00182 or similar document. The effective date of the amendment of the rezoning of Metro Park shall be the later of the date a redevelopment agreement including Metro Park is executed by all parties after approval by the City Council, or the date the above-described document is executed by the National Park Service.
