Dependent special districts presentation

Assistant Council Auditor Kim Taylor made a presentation on the City’s dependent special purpose taxing districts, all of which are for the purpose of dredging private canals and waterways. The City Council approves their annual assessments by ordinance. Council Member Gulliford said that there appears to be a large siltation problem in Jacksonville in recent years and Jaxport is having to budget considerably more than in the past for its dredging needs. He suspects these districts may have to do the same as well. In response to a question from Council President Bowman, Kim Taylor said that the districts pay an administrative fee to the Tax Collector and Property Appraiser for their costs incurred in collecting the assessments. Council Member Boyer pointed out that there are other community development districts (such as Tamaya) that also impose special assessments for roads, recreational facilities, etc. She noted that Jaxport has in the past explored the option of purchasing dredging equipment to serve the dredging needs of the authority’s facilities rather than hiring a contractor and she suggested that if that comes to pass, perhaps these special assessment districts could contract with Jaxport for dredging services in their areas and the City could utilize that equipment for dredging its boat ramps and docks. Council Member Gaffney asked about the potential to create a special district for other kinds of neighborhood improvements apart from dredging. Deputy General Counsel Peggy Sidman noted the possibility of creating Community Redevelopment Area tax increment financing districts to capture a portion of the tax dollars that would otherwise go to the General Fund and also other types of special assessment districts for particular neighborhoods funded by the area property owners.

   Discussion Points:

·          The City has a license agreement with Lutheran Services Florida, Inc. for operating Head Start at 1314 Union Street W (one of the parcels being sold).  The license agreement expires July 15, 2022 and is for $1 per year. The City is permitted to terminate its license agreement with Head Start by providing 30 days’ written notice.

·          Section 7 of the Purchase and Sale agreement states that the City will relocate Head Start to the Florida C. Dwight Park or another mutually agreeable location. 

·          The cost to relocate and renovate an existing structure or possibly construct a new facility is unknown at this time until a location is selected. Per the Agreement, the buyer will contribute $70,000 towards these costs.

·          If the parties are unable to come to an agreement on Head Start’s new location, either party can terminate the Agreement and the buyer will be refunded its deposit.

 

 

Kim Taylor reviewed the amendments as passed by the NCSPHS Committee yesterday, particularly with regard to maintenance of operation of the Head Start program in the area. Daryl Joseph, Director of the Parks, Recreation and Community Services Department, said that he had communicated with Lutheran Social Services and had a letter from that organization agreeing to the terms as outlined in the amendments. Emily Pierce of Load King expressed the company’s agreement with the proposed amendments. Council Member Boyer questioned the use of most or all of the sale proceeds for a new Head Start center, which she believes makes the deal less favorable for the City than the original deal with regard to replacing the park property being lost to the project. Ms. Pierce said that this revision regarding the use of the funds for the Head Start center was requested by the City administration. Daryl Joseph said that the funds will be used to improve a City park building at Florida C. Dwight Park to house the relocated Head Start program and he is working with a contractor to estimate the price of the improvements. Ms. Pierce said that the project would allow Load King to consolidate its operations into an expanded facility and their move out of a remote building would enable the Sheriff’s Office to utilize that full building, of which they currently lease a portion. Council Member Gulliford suggested that the purchase price of the property reflect its value to Load King, which may be above the appraised value for another independent purchaser. In response to a question from Chairman Anderson, Mr. Joseph said that the department’s trail plan does not contemplate any further extension from that site, so this sale would not impact trail plans.

Kirk Wendland of the Office of Economic Development gave an overview of the full service grocery story attraction program (10,000 square feet or more, carrying specified types of food products, in a food desert area) and the incentives that will be offered.There are also possibilities for 4 non-traditional types of solutions such as mobile markets, food delivery systems, etc. Council Member Gaffney said that there are other options such as urban gardening and food bank expansions that might be more cost-effective than this program as proposed. He opposes investing so much money in one potential store operator and said that this program doesn’t reflect his intention in introducing the original food desert legislation last year. Mr. Wendland gave the context for the program and the City Council’s original expectation that a grocer could be attracted to re-open 2 recently-closed supermarkets or build a new grocery store in the Northwest area. This bill creates a program but does not fund any particular project; that would require further Council approval at a later date. Council Member Newby noted that the funding for this project came from the Northwest Economic Development Fund and needs to benefit the Northwest area before other ideas are tried in other parts of the city. Council Member Boyer suggested an amendment to require that the the OED propose allocations of the entire $3 million in funding for a variety of programs before any single project can be approved.

 

Boyer amendment: include a requirement that prior to appropriating funds to any particular project using the grocery store improvement program, OED will have presented to Council via legislation for consideration and approval the 4 other program options recommended by the consultant and propose a funding allocation among all the programs –

 

Council Member Gaffney urged the OED to hold a meeting with all potentially interested parties offering various solutions to the food desert problem.

 

Tony Brown, the OED’s consultant on the grocery store project, said the report finds that the grocery store industry is rapidly changing, particularly in the areas of delivery services and pick-up of on-line purchases at local stores. Attracting capital for a grocery store in this changing industry is a difficult prospect. He supported the spirit of the Boyer amendment.

 

The Boyer amendment was approved

 

Council Member Gulliford said that any program must allow private businesses to make money in order to be successful. He said that Jacksonville has food deserts citywide and will have a hard time finding $1.5 million to attract a store to every area that needs one.

Council Member Boyer explained the Model Mile project and its compatibility with the Park Street Road Diet project and the DIA’s plans for improvements in the area. She explained the transfer of funds among various fair share interest earnings and mobility fee bike and pedestrian funds to free up General Fund dollars that can be used for this purpose. She said that Groundworks Jax has committed to raising $900,000 for this project; if that funding is raised before the end of the fiscal year then it can be budgeted this year or could be budgeted in FY19-20. The City is negotiating a Memorandum of Understanding with Groundworks Jax to act as the manager for the design of the $3.6 million Model Mile project. Kay Ehas, CEO of Groundworks Jax, described the Emerald Trail project as a 20-mile greenway circling downtown and incorporating Hogan’s and McCoy’s Creek and the St. Johns River. The estimated cost is $32 million for the entire Emerald Trail.

Council President Bowman explained the need for the emergency action on the bill today. The company’s permanent facility is under construction now and the hiring process is ready to begin. The company needs help finding office space which the space at Cecil Commerce Center will serve. Kirk Wendland of the Office of Economic Development gave an overview of the Wayfair project (Project Empire) and the request by the company to amend the City standard lease. He described the amendments and characterized them as largely technical in nature. Council Member Gaffney asked to speak to Mr. Wendland separately about the types of jobs available and the company’s willingness to consider hiring of ex-offenders. In response to a question from Chairman Anderson, attorney John Sawyer of the General Counsel’s Office said that the amendments are under review by the City’s Risk Management Office and the contract will be worded as that office requires.

 

The 10 amendments were approved as a Finance amendment.

 

EMERGENCY/AMEND/APPROVE 7-0

1. Eliminate City’s right to terminate for convenience at end of first one year term (Section 1.4).

2. Eliminate required hours of operation for tenant (Section 5.2)

3. Clarify tenant is only authorized to make cosmetic improvements to premises, not structural.

4. Clarify tenant is the sole tenant of the building and has no common area maintenance obligations (Section 6.1)

5. Clarify tenant shall have exclusive use of the parking lot adjacent to the building (Section 6.5).
