Council Auditor Kyle Billy to discuss Report:

#822 – Quarterly Report for the Three Month Ended December 31, 2018

Mr. Billy reviewed a handout summarizing the quarterly report. The report projects a favorable revenue variance of $5 million largely in three accounts – ad valorem taxes, state shared revenues and other miscellaneous revenues (mostly reimbursement from the School Board for use of JSO officers as school guardian officers). A favorable expenditure variance of $3.3 is projected, almost entirely attributable to approximately $3.1 million in the Sheriff’s Office budget. Mr. Billy pointed out the additional unanticipated cost in this year’s budget due to the Sheriff’s Office supplying officers to the School Board to comply with the new state law requiring armed school guardians in all schools. He noted that the JSO overtime budget projects to an unfavorable balance by year-end of $7 million, in part due to the school guardian costs. Mr. Billy noted that the JEA’s one-time contribution of $15 million in 2016 for septic tank phase-out was deposited into the Stormwater Service Subfund 461 and the interest earnings on that deposit contributed to the favorable variance in the Stormwater Services budget. The Finance Department has agreed to allocate future interest earnings from those JEA funds to Water/Wastewater Subfund 463, but not to transfer any earlier interest earnings from Subfund 461 to Subfund 463.

 

Council Member Boyer stated that the TDC’s bed tax revenues are coming in at about the same level this year as last year, while the budget anticipated some growth based on prior trends. She cautioned that if the trend continues, not only will the TDC budget come up short, but the other 4 cents of bed tax collected for debt service on public facilities will also be under budget. Council Member Love said that passing an ordinance to apply the tourist development tax to Short Term Rentals (i.e. Airbnb) would help to remedy this shortfall.

 

CAO Sam Mousa explained that the state law regarding $12/hour funding for guardians equates to a $7.15 hourly wage plus benefits,  which does not generate a sufficient quantity and quality of applicants for those positions. The City is billing the School Board $17.15 per hour for Sheriff’s officers filling those positions in all public and charter schools.  The School Board is reimbursing approximately 38% of the cost of JSO officers serving as guardians, so the City is incurring a net cost of approximately $4.3 million this year to ensure compliance with the state mandate. Bill Clement of the Sheriff’s Office said that this expense was not budgeted in this year’s budget because the law is so new. Mr. Mousa said that he and Mr. Clement are tracking the progress of the expenses for this service and may recommend a budget amendment later in the year as trends develop further.

PFPF Actuarial Report – Timothy Johnson, PFPF Executive Director

Mr. Johnson reported that the City’s contribution to the pension fund was $135 million in December 2018 and will be $140 million in December  2019, mostly due to increases in normal payroll costs for new employees and raises ($4 million of the $5 million additional cost). The PFPF Board elected to apply an asset smoothing methodology to calculate the City’s annual contribution which will smooth out large swings in the amount from year to year. The funding ratio went from 47.2% to 48.5% las year due to asset growth.  The plan has $3.8 billion in liabilities and $1.8 billion in assets. The value of the sales surtax collections for 2018 exceeded the original assumption, making the net present value of the fund’s long term assets higher than the original projection, thus improving the fund’s overall financial position. The net present value of the liabilities is likewise reduced because of the increased value of the future assets. In response to a question from Chairman Anderson about the purpose of the upcoming risk assessment study, Mr. Johnson explained that the current contribution rate is determined by a mandated formula; the fund’s actuary has recommended commissioning a study of the assumptions imbedded in the formula (mortality tables, future investment returns, etc.) to test for their reasonableness. In response to a question from Council Member Love, Mr. Johnson said that if the sales tax continues to produce at the current level, projections show that the unfunded liability would be paid down to the target level well earlier than the 2060 mandatory end of the sales tax. Of course many, many factors will play into the future financial stream, including the rate of employer and employee contributions and the return on invested assets over the next 20-30 years, so caution in projecting future values is urged.

Joe Peppers, CEO of the Kids Hope Alliance, explained the mini grants program for crime and violence prevention and said that 32 new recipient agencies (of 37 total agencies) are participating in City funding for the first time. The new programs were launched in January and February after being approved in the new budget in October. In response to a question from Council Member Gulliford, Mr. Peppers said that the vast majority of the funding has gone to programmatic expenses, not to capital expenditures. Mr. Gulliford questioned what will happen to these programs when the 1-year grant runs out. How will they be sustained in the future, particularly if they are successful? He believes the payment of the grants as reimbursements will be problematic for organizations that don’t have the resources to front the costs of the program and wait for reimbursement. Several council members pledged to try to get more funding for this grant program in next year’s budget. Mr. Peppers introduced several grant recipients to tell their stories.

 

Andrew George, Difference Makers, described his program for young fathers.

Julia Henry Wilson, Jacksonville Urban League, described her program for workforce skills and personal development.

Allyson Galloway Gonzalez, Cathedral Arts Project, described CAPs program for teaching visual arts to young men awaiting trial in the Pre-Trial Detention Center.

Betty Burney, I’m A Star Foundation, described her cooperative program with Alpha Kappa Alpha Sorority to address the needs of young women who are overage for their school grade with regard to confidence and positive personal development.

Ken Pinnix, 100 Black Men of Jacksonville, described his programs to take young men on college tours and teach leadership skills.

 

 

Assistant Council Auditor Kim Taylor described the provisions of the substitute bill listed on the marked committee agenda (including a revised Exhibit 2 attached). She noted that the KHA board will hold a special meeting tomorrow to approve the recommendations for direct contracting with several organizations. Peggy Sidman clarified that the agenda is marked for the committee to approve the NCSPHS substitute, and that Council Member Newby has two additional changes to recommend for a Finance substitute. Mr. Peppers explained Mr. Newby’s additional changes to do RFPs rather than direct contracting for two listed programs.

 

The Finance substitute was approved.

Mr. Clement explained that this appropriation provides for 2 new civilian employees over 3 years and various types of victim services. The grant does not require that these employees be continued after the end of the grant period. Council Member Boyer said that the Task Force on Safety and Crime Prevention is trying to compile a complete inventory of all crime-related programs and funds and asked Mr. Clement to provide the task force with whatever information the JSO can provide about its programs and funds for crime prevention and victim services. Council Member Gaffney said that the JSO has a program that is successful but receives little attention that attempts to intervene in gangs and defuse criminal behavior. Council Member Gulliford asked if the JSO has comparisons of Jacksonville’s ratio of offices per square mile to other combined cities and counties in Florida. Mr. Clement will forward that request to JSO’s crime data section for a response.

Assistant General Counsel Paige Johnston reviewed the 9 amendments approved by the TEU committee, several of which are scrivener’s errors and several of which are substantive. Council Member Gulliford proposed an amendment to amendment #7 to require the original review after the first year and subsequent reviews every two years thereafter. Eric Fuller of the Solid Waste Division had no objection to an initial review after year 1 with subsequent reviews every two years. The Gulliford motion was approved. Mr. Fuller explained the purpose of the bill to capture revenue lost from C&D debris generated in the city but disposed of outside the city. He explained the methodology for calculating the building permit surcharge to generate $2.8 million in new revenue to replace the landfill host fee being repealed with the implementation of the new building permit fee. Council Members Gaffney and Newby asked to be added as co-sponsors of the bill. Council Member Gulliford thanked the Public Works Department representatives (John Pappas, Will Williams, Eric Fuller) and CAO Sam Mousa who worked so long on this project.
