In Public Comment,  John Nooney expressed his view that this proposed legislation should be relegated to the Jacksonville Waterways Commission for that body’s review.

 

Council Member Greg Anderson, one of the sponsors of the ordinance, explained what the proposed legislation entailed.  The ordinance emanated from the work of the Special Committee on Hemming Park, an ad hoc committee that Council President Lori Boyer had appointed to review and assess the contract that the City had with the Friends of Hemming Park.  In the deliberations of that committee, the Jacksonville Sheriff’s Office had raised concerns regarding the enforcement of park’s rules.  Mr.  Anderson explained that the ordinance clarifies the park’s rules and the appeals process.  The Parks, Recreation & Community Services Department, Office of General Counsel, and JSO all had input in crafting the ordinance.  Mr. Anderson further explained that the rules apply to parks throughout the City.

Amend to change exemption for small employers to 50 or fewer employees.

 

There was a lengthy discussion of this item.  The measure’s sponsors, Council Members Bowman, Hazouri and Love, were in attendance .

 

Council Member Bill Gulliford announced that he was offering a substitute, the essence of which is to put the question of expanding the City’s equal rights laws on the ballot in the form of a referendum that would let the voters decide.

 

Council Member Aaron Bowman, one of the sponsors of the measure, stressed the need to enact the legislation to protect the LGBT community in the military, particularly the Navy and its men and women beyond the gates of the naval bases.  Mr. Bowman reported that he had received 3,000+ e-mails on the issue, 90% supportive.

 

Council Member Gulliford argued that organizations that operated within the framework of religious principles would be harmed by the enactment of this ordinance.

 

General Counse Jason Gabriel l referenced the e-mail that he had sent to the Council Members regarding his definition of religious organizations.

 

 Council Member Garrett Dennis felt that  2017-15 does not go far enough in protecting people.  The proposed legislation needs “teeth” because there is no language in I  specifying where an individual should  turn for relief from discrimination.  Mr. Gabriel explained that the City already has apparatus in place, in the Municipal Code, for the redress of grievances stemming from discrimination.

 

Assistant General Counsel Wendy Bynloss explained the administrative process of the Jacksonville Human Rights Commission that addresses discrimination complaints.  2017-15 adds LGBT individuals to the groups that are able to file discrimination complaints with the Human Rights Commission.

Charlene Taylor Hill, Executive Director, Jacksonville Human Rights Commission, explained the different routes that individuals can take to redress discriminatory claims in employment situations. 

 

Council Member Joyce Morgan, in reference to Jason Gabriel’s definition of religious organizations and who would be exempt from the HRO legislation, remarked that organizations such as the Trinity Rescue Mission are heavily affiliated with religion; they have prayer services and are exempt from provisions of the LGBT  ordinance.

 

Assistant General Counsel Stephen Durden cited a case in a United States District Court system where a religious organization  claimed that it was exempt from LGBT laws. The court employed a 9-factor test to determine whether it was a religious organization for the purpose of the law.

 

Council Member Jim Love argued against Council Member Gulliford’s substitute.  Mr. Love explained that he had spoken with the Mayor of Tampa who explained that Tampa had experienced no problems in its enactment of LGBT legislation.  Mr. Love also saw a loss of jobs looming if the City did not enact the LGBT legislation.

 

The Gulliford substitute failed by a vote of two (2) (Carter, Gulliford) to four (4).

 

Council Member Doyle Carter offered an amendment to the original 2015-17 that would exempt small business with 35 or less employees from provisions of the LGBT legislation.  In a friendly amendment to Mr. Carter’s amendment, Council Member Bill Gulliford suggested 50 employees or less would be exempt.

 

On the bill, as amended, the Committee voted 4-2 (Cater, Gulliford) to recommend approval of the ordinance.
