CM Dennis was in attendance to speak on behalf of this resolution. There was a lengthy discussion about this bill, which requests an Attorney General opinion to affirm the General Counsel’s opinion regarding restricting public access to officials’ social media accounts. Steve Durden, Office of General Counsel, was in attendance to speak about the issue. Mr. Durden said that when officials (elected or board members) use interactive social media platforms, those platforms then become public forums and what is posted becomes a public record which must be preserved according to Florida law. The Sunshine Law also dictates that officials who use interactive social media platforms must still follow rules for communication, one may post something but other officials should not comment directly. CMs Boyer and Gulliford both questioned the need to ask for an AG opinion for something the General Counsel has already opined about, which could be seen as a double positive. Ms. Boyer stated her support for home rule, which would allow the local opinion to stand without ratification from the Florida AG. CM Crescimbeni agreed that perhaps the AG opinion may be unnecessary but it would create no harm. The Chair deferred this bill, with the request that General Counsel Jason Gabriel attend the next Rules Committee meeting to answer questions about this bill.
