There was a lengthy  discussion on this agenda item.  There were several speakers that either supported or opposed granting the CON.

 

Council Member Reggie Gaffney initially requested that the item be deferred.

Council Member John Crescimbeni asked Assistant General Counsel Paige Johnston if there was language in the Ordinance Code that referenced the “need” or “necessity” for CONs?  Ms. Johnston explained that while the Ordinance Code delegated to the City Council the decision on deciding on whether there was a “necessity” or “need” for a particular CON, The Code does not provide criteria for the City Council to determine “need” or “necessity.”

 

Council Member Danny Becton offered an amendment that would require recycling operators to recycle at least 80% of the material that the contractor receives.  The amendment was approved.

 

Council Member Crescimbeni explained his concerns about the lack of any criteria with which to determine “need” or “necessity” and indicated that he would not vote for the proposed legislation.

Dave McDaniel, Chief, Mowing and Landscape Maintenance Division, Public Works Department, and Assistant General Counsel Susan Grandin explained the two competing amendments  (Finance Committee amendment and the Neighborhoods , Community Services, Public Health and Safety Committee amendment).

 

The two contracts were put out as separate bids because the continuing contract prices came in so high.  Council Member Danny Becton opposed appropriating funds before the bids came back. Council Member Al Ferraro was in agreement with Mr. Becton on the point that the City is asking too much in its bid packages to get better prices.  Mr. McDaniel explained that the Public Works Department is working on getting back to a continuous planting contract with better prices. He explained that the department will ask for tiered bids for different levels of work, hopefully by the end of January.  Mr. McDaniel thinks that these small projects will help bidders be comfortable with the continuous contract.

 

Assistant General Counsel Susan Grandin explained that small bids should help attain bidders.  She suggested an amendment to make the $166,000 a maximum amount, with any excesses returned to the Tree Trust Fund. 

 

Council Member Becton characterized the process as backwards, contending that if you appropriate $166,000, the bids will be $166,000.  He favors the concept of bids with lots of options.

 

Council Member Lori Boyer explained that funds would have to be available prior to the bid process; that is how the City operates and that setting a maximum amount challenges the bidders to be competitive and will tell the City where the marketplace stands.

James Richardson, Environmental Protection Board, explained that the pilot program uses natural microbes to in stormwater ponds to meet nitrogen reduction targets by 2023.  He explained that several other cities use microbes but are not getting FDEP credits for the reductions. Jacksonville’s pilot project will serve as the basis for an FDEP Best Management Practice and should achieve TMDC  (Total Maximum Daily Loads) redits.

 

Robert Kermitz, England, Thims & Miller, explained that other cities using microbes are using them to address specific problems (red tide, sewage spills, etc).  Jacksonville will treat 18 ponds and measure nitrogen reduction for the credit amount .

 

Council Member John Crescimbeni thinks that a university, FDEP and producers of the microbes should pay for the research since the whole state will benefit if it works.

 

Council Member Becton wanted to know how does testing retention ponds help with credits.  Mr. Kermitz  explained that they  are retention ponds that discharge to waterways ultimately.
