response to a question, Assistant Council Auditor Janice Billy explained the
authorized uses of the Environmental Protection Board Trust Fund, which
includes one-time, special purpose studies on environmental issues. Council Member Lee expressed her opposition
to using the EPB Trust Fund as the source for this project because it
collects revenues in the form of citations for violations of environmental
regulations in particular areas and this bill would appropriate those
neighborhood-derived funds to a city-wide purpose rather than for remediation
of the conditions that caused the cited violations. She also expressed her opposition to
sole-sourcing the study to JU rather than opening up the process for
competitive RFPs, and opposed the lack of clarity
caused by the inclusion of language stating that the project is to be
contracted to “JU, among others”. Assistant
General Counsel Peggy Sidman explained how the Procurement Code makes
provision for sole-source contracts to obtain particular expertise or to
support the particular needs of litigation.
Council Member Bishop explained that the purpose of the bill is to
allow Jacksonville to “get out in front” with real data on the issue of water
withdrawals from the St. Johns River before the Water Management District
begins making decisions on applications for consumptive use permits, such as
the one currently pending for Seminole County which may be decided next
week. JU and UNF are already
performing a study of many aspects of the condition of the Council
Member Bishop expressed his willingness to amend the bill to delete the words
“among others” to clarify that the contract is to be awarded to JU. Council Member Joost offered that deletion
in the form of an amendment. Council
Member Graham noted that the bill should have been referred to the Rules
Committee as it contained an Ordinance Code waiver, but did not appear to
have been referred there. Peggy Sidman
explained that, absent a referral to the Rules Committee for this committee
cycle, action on the bill would require a 2/3 vote of the City Council to
approve it next Tuesday, either by way of waiving the requirement that the
bill be referred to Rules for consideration of the waiver issue, or by way of
discharging it from Rules should the bill be referred there by the Council
President this week. Alternatively,
the Rules Committee might hold a special called meeting before next Tuesday’s
Council meeting to consider the bill. DEFER |
