Assistant General Counsel Dylan Reingold explained the need for the agreement, caused by a PUD project that straddles the city line between Jacksonville and Atlantic Beach.  Lots will be permitted by the jurisdiction in which they lie, and the 5 lots that fall in both jurisdictions will be permitted by the city in which the majority of the lot lies.

Chairman Shad explained that he introduced the bill at the request of several San Marco restaurant owners who wish to allow dogs to be present with their owners in the outdoor dining section of their restaurants.  Committee members questioned how the $250 permit fee was arrived at.  Deputy General Counsel Steve Rohan, the bill’s author, explained that state health regulations currently prohibit animals from being present in food service establishments and several restaurants in Jacksonville have been cited for violations for patrons having their dogs with them in outdoor dining areas.  The Florida Legislature enacted a pilot program in 2006 allowing restaurants to apply for permits that would enable them to allow dogs only (no other animals included) in outdoor dining areas that meet certain physical and regulatory criteria.  This bill would allow Jacksonville restaurants to participate in the pilot program.  The $250 permit fee was his estimate of what is needed to cover the costs of permit processing, on-site inspections of premises, etc.  Mr. Rohan stated that the pilot program requires that the City Council approve or disapprove each individual permit application – that function cannot be delegated to an administrative office.  Council Member Graham stated that the city of Jacksonville Beach has delegated that authority to its planning commission.  Mr. Rohan was of the opinion that the law was very explicit in this area, but that an Attorney General’s opinion could be sought if greater clarity is desired.

Council Member Lee arrived.

 

Chief Deputy General Counsel Cindy Laquidara explained the background behind the dispute, the proposed settlement, and the proposed amendment.  This settlement reduces the City’s ultimate liability for disputed charges from $3.1 million plus a $350,000 continuing annual obligation to approximately $2.2 million.

 

EMERGENCY approved to settle the dispute as quickly as possible now that agreement has been reached between the two parties.

 

AMEND to change the word “printing” to “copying” in the bill title, correct a grammatical error on pg. 1, line 17, and to add the required emergency adoption language.

 

RECOMMEND APPROVAL AS AMENDED, AS AN EMERGENCY 5-0
