Council
Member Hyde described the rationale behind his proposed reform of the Public
Service Grant process. The two major
features of the new system are the creation of a Public Service Grant
Committee to function as the equivalent of the Cultural Services Grant
Committee in the arts and culture grant process, and the establishment by
City Council each year of “priority populations” toward which the Public
Service Grant Committee should direct the majority of the available funding. APPROVE 4-0 A
floor amendment will be proposed at the Council meeting to change the date by
which the Council must establish the Priority Populations for 2008 (the bill
currently requires establishment by January 15, 2008). |

Barton, Executive Director of the JEDC, described the reasoning behind the
amendment and the rationale for making the City ordinance match the state
law. He stated that this new procedure
would be the rare exception rather than the rule, and is intended to allow the
City to respond in a rapid manner to an unsolicited proposal for use of City
property that is determined to be in the public interest. Council Member Lee expressed concerns about
the possibility that a shortened process would be detrimental to the ability

response to a question from Council Member Lee, Bob Williams of the Real
Estate Division explained that the fact that several of the parties from whom
the City is seeking easements have hired attorneys to challenge the proposed
easement valuations is not at all unusual; the City is used to property
owners using the provisions of state law to have the City fund their attorney
and independent appraisal in an attempt to get more compensation for the
property than the City’s assessed value. AMEND to attach revised Exhibit 2 to correct legal description and map. RECOMMEND APPROVAL AS AMENDED

Diebenow of the Mayor’s Office, who negotiated the agreement with the Clerk
of the Courts, described the on-going disagreements between the two parties
resulting from the Article V Constitutional revisions to the state court
system several years ago. The problem
is not uncommon around the state, but The
committee engaged in considerable debate about the need for emergency action
and about the relative merits of the proposed Memorandum of Understanding
versus a J-bill solution versus the binding legal opinion/potential lawsuit

At the conclusion of the
agenda Council Member Joost informed the committee that he is in the process of
researching a potential amendment to the Tree Protection and Related Expenses
Trust Fund that would increase the amount of the fund that could be used for
maintenance of trees rather than strictly for new tree planting. He thinks it is prudent to invest more than
the currently allowable 10% of the fund in keeping trees alive and healthy
instead of planting new trees that subsequently die and don’t serve the
function of replacing the benefits of the trees that were removed that produced
the revenue to the trust fund.
There being no further
business, the meeting was adjourned at 4:25 p.m.
