Jay Demetree representing the building’s owner explained that his company paid for extensive renovations to the building to accommodate the court facilities housed there when the building was first leased 5 years ago and did not amortize the full cost of those renovations in the original $11.75 p.s.f. lease rate because it would have exceeded what the City could afford to pay at that time.  There was an understanding at the time that the owners could recoup those costs through an increase in the lease rate in the succeeding lease renewals.  That is why the rate is increasing more than current real estate market conditions might otherwise warrant.

Kristina Nelson of the General Counsel’s Office explained that the City needs to accept a subordination of its easement rights across a parcel in Talleyrand to a DEP restrictive covenant that restricts use of the property due to petroleum contamination of the groundwater.  A concurrent agreement between the City and the property owner will indemnify the City against any additional costs incurred as a result of the contamination if the City needs to do work in the easement.
