The meeting was called to order at 1:31 p.m. by Chairman Corrigan. 

 

Assistant Council Auditor Janice Billy reviewed the Auditor’s marked agenda which included 7 items to be deferred, 19 items ready for action, and 22 items to be read a second time and re-referred.  The Chairman indicated that Resolution 2009-38 (recommending that City, Sheriff and JAA begin discussions toward merging JAA police into the JSO) will be moved for withdrawal at the request of the sponsor, Councilman Yarborough.  The Chairman also indicated that 2009-31 (transfer of surplus rescue vehicle to Ghana) will be deferred after a deferral earlier today in the Rules Committee.

 

Council Member Joost asked with regard to 2008-983 (corrections officers’ pension benefits) if the adoption of a waiver to recognize that the bill was introduced as incomplete legislation without the required certification of the current pension funding level meant that the first two elements of the three-part pension benefit expansion, also enacted without the required certification, were thereby invalid.  Chief Deputy General Counsel Cindy Laquidara indicated that it is a complex matter of law involving the combined effects of both the City Council Rules as it relates to introduction of legislation and state law concerning collective bargaining agreements.  It is the opinion of the Office of General Counsel that any defects in the adoption of phases one and two of the three-part pension benefit could be cured by adding a provision to this new legislation that would be retroactive to two prior adoptions.  With regard to proper public notice, the courts will be looking for whether the public had fair notice of the actions being considered and a fair opportunity to comment on and provide input to the process.

 

Mr. Joost suggested and Chairman Corrigan agreed on the need to have a complete timetable of all the relevant actions with regard to the pension bill: when did the 90% funding requirement for introduction of a pension enhancement take effect?  What were the actuarial funding levels of the plan when the 2 prior phases were enacted?
