Council
Member Clark suggested the need to refer the bill, if amended as proposed, to
the Rules Committee given its invocation of an exception to the Ordinance
Code. Council Member Joost spoke in
opposition to taking action on the bill without knowing the actuarial impact
on the already-underfunded pension plan.
Deputy General Counsel Steve Rohan conveyed the Council President’s
desire that the bill be voted on in committee and not deferred for another
cycle. Council Member Webb cited the need
to honor the collective bargaining process that produced this bill enacting
an agreed-upon benefit. DEFER (Corrigan and Webb

Member Yarborough announced that as a result of the Finance Committee’s
deferral, the PHS Committee would defer action on the bill today as well. |

Council
Member Joost made a presentation on pension funding and the impact of
previous mayors and city councils taking pension funding holidays and urged
that the practice be specifically prohibited in the future. Council Member Webb asked if the
prohibition against pension funding holidays, if adopted, could be
strengthened by imposing a super-majority vote requirement to override. Mr. Rohan stated that the only way to impose
such a requirement is by amending the City Charter, since the Council can
waive any Ordinance Code provision, including a super-majority requirement,

response to questions from the committee, Assistant General Counsel Kristina
Nelson and ash site remediation project manager Jim Manning of the
Environmental and Compliance Department explained the EPA ash site consent
decree and its requirement that the City fund the hiring of independent
technical advisors by the affected communities to help them understand the
remediation plan and actions being taken.
Without these independent advisors in place the EPA will not allow the
