12 We do not have much tonight that is really
13 going to have any action on it, but we have a
14 visiting council member with us tonight,
15 Mr. Yarborough, and he has asked that we take up
16 his item first. And being in the Christmas
17 spirit already, I will grant that request.
18 MR. YARBOROUGH: Thank you, Mr. Chairman.
19 I didn't know how light your agenda was,

21 THE CHAIRMAN: It's not much.
22 MR. YARBOROUGH: -- want to go in order,
23 it's certainly your preference as the Chair.
24 THE CHAIRMAN: Let's all turn to page 8,
25 item number 20, 2009-832. We will open that

3 THE CHAIRMAN: And, let's see, while we're
4 in the public hearing, can we have Mr. Crofts
5 read the amendment?
6 And then, Ms. Green, you can stand by and
7 listen to the conditions and we can go into all
8 the discussion.
9 MR. CROFTS: Mr. Chairman and members of
10 the committee, the conditions to the PUD,
11 2009-832,
12 following conditions:
13 Number 1, "The developer shall be subject
14 to the original legal description dated
15 September 30th, 2009."
16 Number 2, "The developer shall be subject
17 to the revised written description dated
18 November 24th, 2009."
19 Number 3, "The developer shall be subject
20 to the original site plan dated September 30th,
21 2009."
22 Number 4, "The required transportation
23 improvements shall be made in accordance with
24 the Development Services memorandum dated
25 October 20th, 2009, or as otherwise approved by

1 the Planning and Development Department."
2 Number 5, "A landscaping plan for the
3 parking area shall be submitted, subject to the
4 review and approval of the Planning and
5 Development Department, at the time of
6 verification of substantial compliance. The
7 landscaping shall be installed within the sixth
8 month of occupancy."
9 Number 6, "At the time of verification of
10 substantial compliance, a determination shall be
11 made by the Planning and Development Department
12 and the
13 whether a bus shelter is warranted. The bus
14 shelter, if warranted, shall be installed within
15 three months of this determination date."
16 Number 7, and -- let's see. Number 7, "The
17 maximum building height shall be 60 feet."
18 And, number 8, "Enrollment of more than
19 300 students" --
20 MS. GREEN: Forty-five.
21 MR. CROFTS: I stand as corrected.
22 "The maximum height shall be 45 feet."
23 "Enrollment of more than 300 students shall
24 be reviewed and approved through the minor
25 modification process."

9 I just -- these are some changes that have
10 kind of happened on the fly, at least in -- in
11 what I've seen from what's in the book.
12 Mr. Crofts, can you please run by the JTA
13 bus shelter condition and the maximum height
14 condition again, please.
15 MR. CROFTS: Condition number 6, "At the
16 time of the verification of substantial
17 compliance, a determination shall be made by the
18 Planning and Development Department and the
19
20 bus shelter is warranted. The bus shelter, if
21 warranted, shall be installed within three
22 months of the determination date."
23 Condition number 7, "The maximum building
24 height shall be 45 feet."
25 And the others are as I read before.

5 enrollment condition still a condition for this

8 sir, that is correct.

16 Kupperman, recommending -- representing the
17 landowner,

19 Can I ask one clarification?
20 THE CHAIRMAN: Absolutely.
21 MS. GREEN: We did -- it wasn't -- we kind
22 of worked all this out last week before the
23 holiday.
24 The 300 students, that's -- anything beyond
25 that is a minor modification; is that correct --

2 MS. GREEN: -- if it is a school?
3 And the bus shelter thing was something
4 that we worked hard on over the last two or
5 three weeks, and I just sort of had a thought,
6 and I ran it past Councilmember Yarborough. And
7 it's not like I'm trying to sneak something in,
8 but -- since we would be negotiating with the
9 JTA on -- indicating whether or not the need is
10 there, suggesting that that need is proven and
11 it is determined that we will participate in
12 that, I was wondering if we shouldn't change the
13 word to "begin construction."
14 I don't know how long it takes. I don't
15 know how long it would take to get the money on
16 the private partnership from the JTA, so forth.
17 I mean, I -- I just know that when you try to
18 amend the condition after the fact, that's a
19 full-blown rezoning, and I would -- just kind of
20 trying to give us a little bit more leeway
21 there.
22 THE CHAIRMAN: How would that read again,
23 Mr. Crofts, if it were to be changed? Let us
24 hear how it would read. If a determination has
25 been made . . .

1 MS. GREEN: I would just suggest
2 "construction shall begin within three months"
3 as opposed to "it shall be installed within
4 three months."

6 MS. GREEN: Oh, I did go -- excuse me,
7 Mr. Chairman -- and indicate to Mr. Yarborough
8 that I was going to bring this up. He
9 doesn't --
10 MR. CROFTS: I apologize. It's slipped
11 around on me.

17 The next sentence reads, "The bus shelter,
18 if warranted, shall be installed" -- operative
19 word here being "installed" -- "within three

23 discussed" at that meeting? I mean, what if
24 there's some discussion between JTA and timing
25 and all that? That's all I'm worried about.

24 I mean, maybe in that discussion that my
25 client and the Planning Department and you and

1 the JTA have, you know, maybe it's decided that
2 they want it, but it will be in another cycle.
3 I mean, I don't know. I just hate to see us
4 get -- and I wish I thought about it ahead of
5 time, I really do, but I just hate to get locked
6 in to 90 days that feasibly through their
7 authority and their board and us and
8 construction that maybe it didn't happen and
9 we'd be out of compliance.
10 THE CHAIRMAN: Okay.
11 MS. GREEN: Even with the intentions that
12 we would do it if it's determined that it's --

15 the surrounding community. And November 18th,
16 4:30, in my office, with Ms. Green, talked about
17 the revised PUD conditions, and that's all the
18 ex-parte I have.

14 now with it being installed, it's somewhat open,
15 but it gives the impression, I guess, that it
16 would be completed, but what -- what is
17 Planning's take on that?
18 MR. KELLY: I guess the -- "begin
19 construction," I mean, is there an end time
20 frame? It shall be completed within 120 days
21 maybe is -- you know, it shall begin
22 construction within 90 days and shall be
23 completed within 120 days so that there's four
24 months to get a stop --
25 MR. YARBOROUGH: And I think that's a good

1 point, through the Chair, Ms. Green, just
2 because we -- the way it was written before was
3 "installed," which was open, but kind of -- kind
4 of closed, but Mr. Kelly makes a good point
5 because it's going to come back to even see if
6 it's warranted to begin with.
7 So if it is started, it would be good to
8 put in there something to say it will be done
9 by --
10 MS. GREEN: Right. And I -- through the
11 Chair to Mr. Yarborough, Councilmember, I
12 agree. I was just really concerned that in that
13 meeting, if, in fact, it is determined that
14 there's something that happens in getting a
15 JTA-approved bus stop -- you know, maybe you've
16 got to go to TEU or something. You know what
17 I'm saying? I didn't know what that would be,
18 when that would be. If we ever got held up by
19 that, would we be in default of the PUD? But I
20 guess we'll just work it out at that time.
21 I appreciate your amendment, Mr. Jones.
22 THE CHAIRMAN: Mr. Jones, did you want to
23 restate your amendment?

4 90 days? Which is a total of --
