17 Mr. Chairman, this is the PUD zoning that
18 accompanied a land use amendment that went
19 through on the last cycle. It's an 80-acre
20 parcel.
21 I'm here for questions.
22 We've worked closely with the communities
23 and would welcome any questions that you might
24 have.
25 And I would like for the amendment to be
Diane M. Tropia,
12
1 read into the record, if you wouldn't mind.

8 I know you've closed the public hearing,
9 but if I could just --
10 THE CHAIRMAN: Well, we'll reopen it.

Diane M.
Tropia,

2 they are committed to training everyone that
3 works there in making sure that they understand
4 that -- to access this site, it is only to be
5 that way.
6 MR. HOLT: I don't see any reason why they
7 would even want to turn in the other
8 direction --
9 MS. HIPPS: Right.
10 MR. HOLT: -- but --
11 MS. HIPPS: Well, we're just wanting to
12 make sure that was on the record for the
13 neighborhoods to the north of us, and that's
14 absolutely the way that it will be.
15 MR. HOLT: Right, which is in my district.
16 Thank you, ma'am.
17 MS. HIPPS: Okay. Thank you.
18 THE CHAIRMAN: So, Mr. Crofts, we're all in

13 MS. ELLER: To the Chair, I'll have the

18 THE CHAIRMAN: Thank you.
19 MR. HUXFORD: Thank you, Mr. Chairman.
20 Yes, this is a waiver request along

13 (Audience member approaches the podium.)
14 AUDIENCE MEMBER: Hi. I had a question.
15 Okay. Can I ask it now?
16 THE CHAIRMAN: Sure.
17 AUDIENCE MEMBER: Okay. In terms of the
18 rezoning of the property, which, I believe, is
19 at the northeast quadrant of 9A and Beach
20 Boulevard, there is another -- there's a
21 subdivision that's located right behind that
22 that's called Beachwood. I was just curious
23 whether or not the rezoning decision would
24 affect the property rights of the Beachwood
25 owners.
Diane M.
Tropia,
21
1 (Mr. Harden approaches the podium.)
2 MR. HARDEN: Mr. Chairman, would you mind
3 if we defer it for a couple of items? Let me
4 show her where it is, and I'll -- maybe I can
5 answer her question, and then --
6 THE CHAIRMAN: Okay. I'll table it. And
7 then if he answers your questions, we'll get it
8 back.
9 MR. HARDEN: Thank you.
10 AUDIENCE MEMBER: Thank you.
11 THE CHAIRMAN:
12 MS. ELLER: Yes, sir.
13 THE CHAIRMAN: If I table an item, do I
14 technically have to close the public hearing and
15 reopen it or --
16 MS. ELLER: No. You just continue it.
17 THE CHAIRMAN: Okay. We'll just continue
18 it.
19 Okay. 2009-188. Open the public hearing.
20 There are no speakers. We'll continue that
21 public hearing and take no action tonight.
22 2009-189. Open the public hearing.
23 No speakers. We'll take no further action
24 and continue that public hearing.
25 2009- -- at the bottom of page 10 -- -235.
Diane M.
Tropia,
22
1 MR. HOLT: (Inaudible.)
2 THE CHAIRMAN: We took that up early.
3 2009-235.
4 MR. HOLT: (Inaudible.)
5 THE CHAIRMAN: Somebody's got to move it.
6 MR. HOLT: (Inaudible.)
7 THE CHAIRMAN: Okay. Never mind. It's a
8 second and rerefer.
9 Let's see. 2009-236, -237, -238, -239,
10 -240, -241 are all second and rereferred.
11 MS. LAHMEUR: (Inaudible.)
12 THE CHAIRMAN: So we need to move the subs.
13 Okay. 2009-239.
14 MR. HOLT: Move the sub.
15 MR. BROWN: Second.
16 THE CHAIRMAN: Seeing no speakers, open the
17 ballot.
18 (Committee ballot opened.)
19 MR. JOOST: (Votes yea.)
20 MR. BROWN: (Votes yea.)
21 MR. HOLT: (Votes yea.)
22 MR. REDMAN: (Votes yea.)
23 (Committee ballot closed.)
24 THE CHAIRMAN: Record the vote.
25 MS. LAHMEUR: Four yeas, zero nays.
Diane M.
Tropia,
23
1 THE CHAIRMAN: By your action, you have
2 moved the sub to 2009-239.
3 2009-240.
4 MR. HOLT: Move the sub.
5 MR. BROWN: Second.
6 THE CHAIRMAN: Seeing no speakers, open the

21 All the items on page 13 are second and
22 rereferred.
23 And I just want to make a note, on
24 2009-248, I believe there's going to be a
25 special hearing in LUZ on April 6th [sic], so
Diane M.
Tropia,
24
1 all the members may want to go ahead and mark
2 their calendars.
3 All the items on page 14 are second and
4 rereferred.
5 And we've got one item left on the table.
6 Where is Mr. Harden? Is he --
7 MR. HARDEN: We're back here.
8 THE CHAIRMAN: We'll take a five-minute
9 recess.
10 MR. HARDEN: Mr. Chairman, we're finished.
11 (Audience member approaches the podium.)
12 THE CHAIRMAN: Go ahead.
13 AUDIENCE MEMBER: Yes. I had a question
14 with respect to the rezoning decision. My
15 question was, will the rezoning decision, if
16 passed, affect the ownership rights for any of
17 the Beachwood homeowners?
18 (Mr. Harden approaches the podium.)
19 MR. HARDEN: Paul Harden, 501
20 Avenue.
21 I was showing her where this is located.
22 My client owns the apartment complex which
23 is to the north of this site. It's an adjoining
24 parcel to the subdivision where her mom and dad
25 live.
Diane M.
Tropia,
25
1 Our zoning is not changing anything. The
2 frontage in front of them already is CCG-2.
3 This is a remnant parcel left over from a
4 taking of 9A. We have a user that wants to go
5 in there, particularly a hotel use.
6 The access -- only access is through our
7 entryway onto -- back through to the apartment
8 complex, which is, I guess, a half a mile from
9 your mom's house?
10 AUDIENCE MEMBER: Right.
11 MR. HARDEN: Something like that.
12 So, other than that, we -- we're pointing
13 to the Planning Department report.
14 Let me clarify one thing. While the
15 application and the advertisement are correct,
16 the --
17 MS. ELLER: The bill is correct.
18 MR. HARDEN: And the bill is correct,
19 thank you.
20 The indication on the agenda is CCG-1.
21 It's, in fact, CCG-2, the use that's proposed on
22 the site, so . . .
23 Other than that, I'll be happy to answer
24 any questions.
25 THE CHAIRMAN: Does the Planning Department
Diane M. Tropia,
26
1 have any comment on the effect of any possible
2 value to the adjacent landowners?
3 MR. CROFTS: Mr. Chairman, members of the
4 committee, we have evaluated the recommendation,
5 and we have recommended approval. And, based on
6 the typical criteria that we utilize in terms of
7 consistency and furtherance of the -- with the
8 comprehensive plan and its appropriateness as it
9 relates to the land development regulations, and
10 that -- from that perspective, in looking at the
11 location and in the context of where it's
12 located, we are in support.
13 THE CHAIRMAN: All right. Well, we'll
14 close the public hearing.
15 Ms. Brown, are you satisfied?
16 AUDIENCE MEMBERS: (No response.)
17 THE CHAIRMAN: Did she leave?
18 I'm going to assume she must be satisfied,
19 so -- do you want to move the amendment?
20 MR. HOLT: I thought we already moved the
21 amendment.
22 Move the amendment.
23 MR. REDMAN: Second.
24 THE CHAIRMAN: The amendment has been moved
25 and seconded.
Diane M. Tropia, P.O. Box 2375, Jacksonville, FL 32203

1 All those in favor say aye.
2 COMMITTEE MEMBERS: Aye.
3 THE CHAIRMAN: All those opposed.
4 COMMITTEE MEMBERS: (No response.)
5 THE CHAIRMAN: The amendment passes.
6 MR. HOLT: Move the bill as amended.
7 MR. REDMAN: Second.
8 THE CHAIRMAN: Seeing no speakers, open the
9 ballot.
10 (Committee ballot opened.)
11 MR. JOOST: (Votes yea.)
12 MR. BROWN: (Votes yea.)
13 MR. HOLT: (Votes yea.)
14 MR. REDMAN: (Votes yea.)
15 (Committee ballot closed.)
16 THE CHAIRMAN: Record the vote.
17 MS. LAHMEUR: Four yeas, zero nays.
18 THE CHAIRMAN: By your action, 2009-164 has
19 passed as amended.
20 And that's the end -- any comments?
21 COMMITTEE MEMBERS: (No response.)
22 THE CHAIRMAN: That's the end of our
23 Land Use and Zoning meeting.
24 Thank you.
