21 THE CHAIRMAN: All right. First of all, if
22 anybody is here for Mayport, which would be
23 items 16, 17, and 18, there's no public hearing
24 tonight. So if anybody just happened to be
25 here, those will be readvertised and announced
Diane M.
Tropia,
4
1 in plenty of time for the public to respond.
2 So, with that, I'll open the public hearing

5 THE CHAIRMAN: Seeing no speakers, we will

17 hearing on those items.
18 Are there any speakers?
19 AUDIENCE MEMBERS: (No response.)
20 THE CHAIRMAN: Seeing no speakers, we will
21 close the public hearing on those items.

8 MS. LAHMEUR: Five yeas, zero nays.
9 THE CHAIRMAN: By your action, you have
10 passed -1025.
11 MR. CROFTS: Continuing on, item 22, item
12 2008-1069. I mentioned at the agenda meeting
13 that there was a possibility that we would take
14 this bill up. I have had a conversation with
15 the district councilperson, and he has contacted
16 the applicant and we're going to open and
17 continue -- we're all in concert to open and
18 continue this legislation one cycle.
19 THE CHAIRMAN: Okay. Let's open the public
20 hearing.
21 MS. ALLEN: (Inaudible.)
22 THE CHAIRMAN: Don't open the public
23 hearing?
24 MS. ALLEN: (Inaudible.)
25 THE CHAIRMAN: Okay. Seeing no speakers,
Diane M.
Tropia,
7
1 the public hearing is closed and we will
2 continue.

4 public hearing on that bill. It is intended to
5 be continued.
6 THE CHAIRMAN: Okay. Open the public
7 hearing.
8 Seeing no speakers, that public hearing is
9 closed and being continued -- is open and
10 continued.
11 MR. CROFTS: Item 24, 2009-12. We have
12 a -- we have no public hearing, but I do believe
13 we have a representative from the Office of
14 General Counsel to give us a report on this
15 bill.
16 THE CHAIRMAN: Actually, the local
17 councilperson requested for this to be deferred,
18 so do we want the report or do we just go ahead
19 and defer it and we'll take the report when it
20 comes up for action?
21 MR. CROFTS: I believe that we can probably
22 defer the report until it's ready for action,
23 sir.
24 (Mr. Duggan approaches the podium.)
25 MR. DUGGAN: Mr. Chairman.
Diane M.
Tropia,
8
1 THE CHAIRMAN: Mr. Holt.
2 MR. HOLT: Thank you, Mr. Chair.
3 I was just wondering if we had a reason for
4 this deferral, why Councilwoman Lee wants it
5 deferred. Part of that is in my district, but I
6 just was curious as to why she wants to move
7 [sic] it. It's pretty simple.
8 THE CHAIRMAN: Go ahead and answer his
9 question.
10 MR. DUGGAN: I spoke with Councilwoman Lee
11 at about 4:40, after she had sent the e-mail
12 requesting deferral. What she told me is if I
13 would provide her with the ordinance that
14 approved the CDD in the first place to her
15 office for her to review by Friday -- she said,
16 I promise to review it by Friday. If I have any
17 questions, I will pull it on Tuesday night.
18 So what I understood her to be saying is
19 she was fine for it to move tonight and that if
20 she had any questions, she would pull it on
21 Tuesday, and I'm comfortable with that.
22 THE CHAIRMAN: Okay. I have an e-mail from
23 her assistant, which is at basically 4:30 this
24 afternoon, so your conversation took place after
25 that?
Diane M.
Tropia,
9
1 MR. DUGGAN: After that.
2 I mean, I didn't know that she had sent
3 that e-mail, but she and I spoke at 4:40.
4 THE CHAIRMAN: Okay. Very good. Then
5 we'll go ahead and take action on this bill.
6 MR. HOLT: Move the bill.
7 DR. GAFFNEY: Second.
8 THE CHAIRMAN: Seeing that the bill has
9 been moved and seconded, open the ballot.

22 MR. CROFTS: Next items, 25 and 26, which
23 are a companion small scale land use amendment
24 and a rezoning, they have public hearings this
25 evening and are ready for action.
