regular agenda Chairman Yarborough called on the subcommittee chairs to
introduce the invited speakers for the subject matter presentations.
Tree inventory and
management
Council Member Crescimbeni
introduced Shirley Trier, Business Developer and Project Manager for Davey
Resource Group and Vice President of Greenscape of Jacksonville, who made a
presentation about the benefits of tree inventories. Using modern technology (GPS and handheld
computers) it is possible to map the exact location of trees and record the
species, size, condition, approximate age, risk level, and other information
about each tree. This information can be
used to determine a value for the asset that trees represent to their owners,
to develop a maintenance plan for the tree canopy, and to determine the
potential for liability from dead, dying, damaged or diseased trees. The Federal Emergency Management Agency
(FEMA) accepts a well done tree inventory as sufficient evidence to document
tree loss to natural disasters and to establish a value for reimbursement, if
available. Ms. Trier stated that
proper maintenance of trees is vital to maintaining the value of the asset.
Citing property owners
vs. occupants for code violations
Sheriff John Rutherford
stated that the JSO’s Multi-Family Crime Free Initiative has been a great
success when apartment owners and managers buy into the program and give it a
real try. The program helps owners deal
with problem tenants who cause problems for both law enforcement officials and
the property owner/manager. The Sheriff
outlined an ordinance he will be proposing to revise the way the City deals
with nuisance properties that consume large amounts of law enforcement time and
effort. The proposed ordinance will
define “nuisance property” and “nuisance landlord”, and will require the owners
of properties so designated to register the names of all tenants in nuisance
properties with the Sheriff’s Office.
Owners would also be required to attach a “crime free lease addendum” to
all lease agreements that would have the effect of permitting quick eviction of
problem tenants and allowing the Sheriff to act as the landlord’s agent in
dealing with such tenants. Nuisance
property designation would come after 10 police responses to serious offenses
(drugs, prostitution, weapons, serious violent incidents) at a single family
residence or 30 responses to a multi-family residential complex within 12
months. The owner of a designated
nuisance property can avoid the consequences of the designation by enrolling
and participating in the JSO’s Multi-Family Crime Free Initiative. Nuisance designation could be appealed to the
Sheriff and then to the Municipal Code Enforcement Board.
Council Member Brown
suggested the need for better mechanisms to deal with nuisance commercial
properties as well as residential properties.
Council Member Crescimbeni suggested adopting a penalty fee for
excessive use of police services, which has been tried in other
communities. Council Member Brown also
suggested the need for a way to limit or expedite an appeals process that seems
to drag on excessively long and prevent any remediation from taking place. Sheriff Rutherford welcomed additional
comments and suggestions for inclusion in the bill before it is finally
introduced.
Replacement of school
resource officers with off-duty police officers
Sheriff Rutherford stated
that he is happy with the way the school resource officer (SRO) program
currently works and is not inclined to change it. He sees several advantages to the current
system. First, the fundamental premise
of the SRO program is for the officers to develop personal relationships with
the students of each school and with neighborhood businesses to increase the
effectiveness of the officer in heading off problems before they happen. That would be lost if the SRO program was
staffed by a constantly revolving flow whatever officers happened to choose to
work overtime. The Sheriff also values
the fact that he can control which officers get assigned to SRO posts, and so
has the ability to choose just the right kind of officer who would do well in
this very important program. He also
noted that the School Board reimburses the JSO for all of the costs of the
SRO’s, so there is no real cost to the City for those officers at present. He did note that the School Board is looking
at trying to reduce its expenses for the SRO program by hiring its own SRO
personnel. The Sheriff pledged full
cooperation with such officers should the School Board choose that route. He did state that if the School Board hired
its own SROs then the officers currently performing that duty could be returned
to patrol duty, thereby increasing the department’s capacity without having to
increase the current employee cap.
The Sheriff also distributed
a handout showing the total number of vehicles owned by the JSO and how many
are marked vs. unmarked. 75% are marked
and the remainder is detective cars, undercover vehicles and a few traffic
enforcement cars, all of which need to be unmarked. The Sheriff feels he has the appropriate
ratio of marked to unmarked vehicles.
