At the conclusion of the regular agenda the committee discussed several subcommittee items.  Council Member Hyde introduced Karen Bowling, President of Solantic Walk-In Urgent Care, LLC to discuss urgent care clinics and their potential use in dealing with the City’s indigent care obligations.  Ms. Bowling explained that Solantic has several types of joint ventures with hospitals in other parts of the state to provide health care alternatives to emergency room use, and also has arrangements with several large employers to provide health care for their employees and dependents.  Fran Coyne, Director of Sales for Solantic, stated that the company is looking for additional opportunities to partner with cities and counties to provide health care alternatives to the hospital emergency room to indigent citizens, either in stand-alone urgent care clinics or in governmental facilities.  A new concept is a health care “gift card” that is pre-loaded with value for health care procedures which can be purchased by local governments for distribution either to their employees or to the uninsured indigent.  The cards can be customized to provide the type and amount of service desired, and can be used to incentivize healthy behavior (for example, by paying for annual physical exams and other preventive care services).  In Gainesville, Solantic partnered with Shands Hospital to erect an urgent care clinic adjacent to the campus of Alachua General Hospital, which closed this year.  The clinic serves the population that used to use Alachua General as their source of primary health care and did not care to take that business to Shands Hospital.

Council Members Hyde and Joost will schedule a meeting with Solantic officials and the City Human Resources Division to explore ideas for employee health care and potentially for indigent care via urgent care clinics.

 

Council Member Yarborough introduced Kimberly Scott, Chief of the Municipal Code Compliance Division, to discuss several code compliance issues including the placement of large ice production and sales machines and personal on-demand storage (PODS) units and the operation of makeshift car washes.  Ms. Scott reported that there are few regulations on PODS on private property if the property owner has an active building permit for work at the site, provided they are removed within 60 days.  The Ordinance Code was amended in 2007 to require the date of delivery of the unit to the site to be posted on outside of the unit for inspectors to see.  Council Member Corrigan stated that Ordinance 2007-319-E that imposed that requirement was the subject of intense interest by the PODS industry and the proposed amendment to the Zoning Code distributed by Council Member Brown today will probably be the subject of similar interest.  Staff was requested to compile a list of PODS companies in town for purposes of contacting them and inviting input on the proposed revision.  Deputy General Counsel Steve Rohan suggested that regulation of the PODS companies should take place via the business regulation chapters of the Ordinance Code, not in the Zoning Code.

 

Stand-alone ice production machines are allowed in the CCG-2 zoning district, but companies are sometimes placing them in locations where they are not appropriate or compatible with surrounding uses.  In some cases they appear to be occupying required parking spaces for the primary use on the parcel.  Clear definitions need to be developed to distinguish between the large, automated ice production and dispensing units that have begun to proliferate in recent years and the traditional bagged ice storage units frequently found in front of convenience stores and gas stations.  They should be regulated separately.

 

With regard to car washes, Ms. Scott stated that code enforcement generally takes place as a result of response to complaints and takes the form first of citations, then in more serious cases, referral to a special magistrate.  Violations would have to be extremely severe (threat to public health or safety) to contemplate an immediate shutdown without due process and aesthetics are not subject to City regulation (i.e. garish colors and decorations).

 

In response to questions about where Code Enforcement is encountering difficulties in enforcement that might indicate a need to amend the Ordinance Code, Ms. Scott stated that it would be helpful to find a way to speed up the appropriation of money collected as code enforcement fines to expenditure accounts for abatement contractors.  The current system of processing the request through MBRC and then to Council for a 3-reading cycle takes up to 8 weeks.  Council Member Yarborough will meet with Steve Rohan to consider possible solutions.  Ms. Scott also saw a need for a better mechanism to allow Code Enforcement inspectors to access all parts of a parcel of property to identify and flag violations.  Currently inspectors are limited to a direct-line route from the public right-of-way to the front door of the structure (the postman or delivery man route) and may not deviate from that line even if conditions that violate the ordinance are likely to exist elsewhere on the lot.  The committee understood that Chief Deputy General Counsel Cindy Laquidara is researching this issue.

 

The committee discussed the length of time it takes for a building condemned for code violations to be demolished.  Ms. Scott noted that it is the City’s policy to use demolition as a last resort and, to the maximum extent possible, to retain usable building stock, boarded up for public safety purposes.  Council Member Lee requested a list of the 5 or 10 property owners in the City with the most accumulated code violations on their properties (particularly realty companies owning large numbers of structures that are constantly in violation of the applicable codes).  Council Member Yarborough will meet with Ms. Scott to discuss this issue further.

 

Council Member Joost introduced the topic of red light camera enforcement and announced that he had invited representatives of American Transportation Systems (ATS), one of the industry leaders, to make a presentation to the committee on the use of such camera enforcement systems.  He has also invited James Brunet, the Sheriff’s Office legal advisor, to attend to talk about the legal issues involved.  Steve Rohan stated that clear authorization for use of the cameras by the Florida legislature is a key step to moving forward on this issue, as there are numerous lawsuits pending around the state challenging the legality of their use in other jurisdictions which have proceeded without clear legislative authority.  Lisa Rinaman of the Mayor’s Office stated that City officials will be meeting with the Florida League of Cities regarding their efforts to lobby the legislature for the necessary authorization.  Jeff Clements of the Council Research Division handed out a list he had compiled at committee’s request at its last meeting of companies providing red light camera enforcement systems.
