At the conclusion of the
agenda the committee heard presentations from Sean Kelly of the Planning and
Development Department and Kim Scott of the Environmental and Compliance
Department regarding enforcement of codes in connection with roadside peddlers,
sidewalk vendors and operation of unlicensed businesses on both public
rights-of-way and private properties.
Mr. Kelly and Ms. Scott described how the enforcement process and the
severity of potential fines varies significantly depending on what particular
ordinance is being violated, which City department is responsible for
enforcement of that ordinance, and whether the violation is an immediate hazard
to public health and safety or could cause irrevocable damage that merits an
immediate response. In anything less
than the most serious public safety situations, enforcement takes the form of a
warning citation and at least 2 weeks for the owner to correct the violation
before a paying citation is issued. The
problems caused by absentee landlords and property owners who neglect or refuse
to control unlicensed uses operating on their properties was discussed.
The committee discussed the
need to find better mechanisms to unify and simplify investigation and
enforcement and to shorten the time period for taking substantive action
against clear violations. Deputy General
Counsel Steve Rohan was asked to draft new code language to attempt to deal
with the various problems identified by the committee. Mr. Rohan hopes to have a draft ready for
discussion at the first PHS Committee meeting in April.
Council Member Crescimbeni
asked for information on how fire station nicknames are adopted and whether or
not there is a formal process to approve the placement of fire station
nicknames and logos on City-owned buildings and equipment. Fire and Rescue Department Director Dan
Kleman will be asked to attend the next committee meeting to discuss the issue.
