CAO’s Analysis of ORD 2010-798, Apv Fair Share Assessmt with Montgomery Land
Co for “Palmetto Bay RAC” Proj, which was attached to the marked agenda. Council Member Crescimbeni asked who was
going to build the road that was a part of the project; Mr. Peterson replied
that the developer could build the road or anyone else could build the road;
the road does not actually have to be built.

Bill Summary Fact Sheet Council Member Crescimbeni asked Kristina Nelson, Office of General Counsel, to explain the legislation. As CSX Corporate Offices is the actual property, CSX officials (their outside counsel) and Ms. Nelson explained the nature of the contamination and purpose of the legislation. Because of the number of questions and concerns raised, the Chair indicated that he would defer the bill; he felt that the measure was too complicated and wanted to be more comfortable with it. The Chair further indicated that he wanted to meet with the Council Auditor’s Office, Dylan Reingold, Office of General Counsel and the Planning Department to discuss the matter.
