T.R. Hainline explained how the applicant had worked with the City to incorporate more specifics about land uses and use mixes, and elements related to the pending Mobility Plan.  Several conditions recognize the presence of the abutting landfill (Trail Ridge) and include non-interference language and several covenants and restrictions.  Paul Harden, representing Waste Management/Trail Ridge Landfill, reminded the committee that 2 landfills in the county (Sunbeam Road and Girvin Road) were closed before their capacity was exhausted because residences were constructed near the landfills and residents then lobbied the City for the closure of those facilities.  Waste Management intends to fully utilize its site on behalf of the City as a landfill and wants the record to reflect that this development is moving next to the landfill with full knowledge that that’s what’s going to happen. The covenants and restrictions will be filed in the public record and attached to the deeds of each individual property to notify future property owners of their proximity to the landfill and their inability to interfere with the operation and future expansion of the landfill.
