BILL SUMMARY

 

Attorneys Bill Brinton and Karl Sanders made 10 minute presentations regarding the proposed ordinance.  Mr. Brinton stated that the vast majority of Florida local governments prohibit scrolling messages on signs as a distraction to drivers.  The minimum dwell time on changing message signs varies widely from a few seconds to several hours.  The Planning Commission recommended a 3 minute dwell time.  Mr. Sanders stated that the current ordinance is very unclear and not legally enforceable with regard to changing messages and scrolling.  Animated signs are now and would continue to be prohibited.  The bill creates a clearer definition of scrolling and changing messages so that all parts of the ordinance would be more enforceable.  He stated that the Federal Highway Administration issued guidelines in 2007 to the 50 state transportation departments recommending 4 to 8 seconds as a reasonable regulation on changing message signs; the Florida DOT uses a standard of 6 seconds.  The committee members discussed the pros and cons of changing message signs, different lengths of message dwell time, and the degree of distraction to drivers and community visual blight from different types of signs.
